AN ORDINANCE relating to funding for housing and community development programs; amending the City of Seattle 2014, 2015, and 2017 Annual Action Plans to the 2014 - 2017 Consolidated Plan for Housing and Community Development to repurpose funds to Office of Economic Development (OED) neighborhood business district activities, business technical assistance, Section 108 loan repayment activities, and Housing Affordability and Livability Agenda (HALA) implementation activities, and to add disposition of real property; amending Ordinances 124496, 124756, and 125365, which adopted the 2014, 2015, and 2017 Annual Action Plans; amending Ordinance 125207, which adopted the 2017 Budget, by modifying appropriations to various departments and budget control levels in the 2017 Adopted Budget; and ratifying and confirming certain prior acts; all by a 3/4 vote of the City Council.

WHEREAS, the United States Department of Housing and Urban Development (HUD) has required each local jurisdiction seeking certain federal assistance to provide an annual action plan for its current Consolidated Plan for Housing and Community Development, which guides the allocation of funds from the Community Development Block Grant (CDBG) Program, HOME Investment Partnerships (HOME) Program, Emergency Solutions Grant (ESG) Program, and Housing Opportunities for Persons with AIDS (HOPWA) Program; and
WHEREAS, the 2014 Annual Action Plan of the City’s 2014-2017 Consolidated Plan for Housing and Community Development, as adopted by Ordinance 124496, includes $355,000 of under-expended funds; and
WHEREAS, the 2015 Annual Action Plan of the City’s 2014-2017 Consolidated Plan for Housing and Community Development, as adopted by Ordinance 124756, includes $152,500 of under-expended funds; and
WHEREAS, these funds have not been fully expended and the Office of Economic Development (OED) and the Office of Housing (OH) have determined that a more timely and effective use of the unexpended funds is in the 2017 OED: Neighborhood Business District - Only in Seattle program, 2017 OED: Small Business Technical Assistance (TA) & Entrepreneur Support program, 2017 OED: repayment of a HUD Section 108 loan for the Alpha Cine project, and 2017 Housing Affordability and Livability Agenda (HALA) implementation activities; and
WHEREAS, OH has more CDBG Program income than estimated in the 2017 Annual Action Plan, as adopted by Ordinance 125365; and
WHEREAS, the City will convey the Greenwood Senior Center to the Phinney Neighborhood Association for consideration; and
WHEREAS, a draft version of the amendments to the Annual Action Plans was released for public review and comment in November 2017; and
WHEREAS, the amendments to the Annual Action Plans were developed with input from and engagement with the public on a number of community needs assessments and policy documents, and the amendments will be available for public review and comment for 15 days prior to the passage of this ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The 2014 Annual Action Plan of the City’s 2014-2017 Consolidated Plan for Housing and Community Development, as adopted by Ordinance 124496, is amended to allocate $125,516 to the 2017 Office of Economic Development (OED): Neighborhood Business District - Only in Seattle program, $95,000 to the 2017 OED: Small Business Technical Assistance (TA) & Entrepreneur Support program, $84,484 to the 2017 OED: repayment of a Section 108 loan for the Alpha Cine project, and $50,000 to 2017 Housing Affordability and Livability Agenda (HALA) implementation activities, and as shown in Attachment A to this ordinance.
Section 2. The 2015 Annual Action Plan of the City’s 2014-2017 Consolidated Plan for Housing and Community Development, as adopted by Ordinance 124756, is amended to allocate $152,500 to the 2017 OED: Neighborhood Business District - Only in Seattle program, and as shown in Attachment A to this ordinance.
Section 3. The 2017 Annual Action Plan of the City’s 2014-2017 Consolidated Plan for Housing and Community Development, as adopted by Ordinance 125365, is amended to reflect the addition of disposition of real property and 2017 HALA implementation activities as a new project, increase the amount of Program Income and CDBG funding from 2014 and 2015 of $278,016 to the 2017 OED: Neighborhood Business District - Only in Seattle program, $95,000 to the 2017 OED: Small Business TA & Entrepreneur Support program, $84,484 to the 2017 OED: repayment of a Section 108 loan for the Alpha Cine project, and $50,000 to 2017 HALA implementation activities, and as shown in Attachment A to this ordinance.
Section 4. The Mayor and the Human Services Director (“Director”) or their designees are authorized to submit the adopted amendments to the Annual Action Plans (AAPs), together with any necessary supplementary material, to the United States Department of Housing and Urban Development (HUD) under certain HUD programs; to represent the City in seeking HUD approval of the amendments to the AAPs; to make and submit to HUD such modifications to the AAPs as HUD may require, provided that no substantial policy changes are involved; and to sign and deliver on behalf of the City such assurances and certifications as may be necessary to obtain HUD approval. The Director or Director’s designee is further authorized to make such technical and conforming changes to the AAPs as may be deemed reasonably necessary, to reflect the changes adopted in this ordinance and to provide any formal submittals to HUD to effectuate the changes adopted in this ordinance.
Section 5. The appropriations for the following items in the 2017 Adopted Budget are increased for the funds shown, as follows:

Section 6. Unspent funds appropriated in this ordinance shall carry forward to subsequent fiscal years until they are exhausted or abandoned by ordinance. In accordance with RCW 35.32A.060, the foregoing appropriations are made to meet actual necessary expenditures of the City for which insufficient appropriations have been made due to causes which could not have been reasonably foreseen at the time of developing the 2017 Budget.
Section 7. The implementation of any specific project or program is also subject to a final determination by the appropriate office or department after completion of any necessary review under environmental and related laws. No part of the AAP is intended to confer any legal rights or entitlements on any persons, groups, or entities.
Section 8. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
