AN ORDINANCE relating to the 2018 Families, Education, Preschool, and Promise Levy; approving an implementation and evaluation plan as required by Ordinance 125604; amending Ordinance 125724, which adopted the 2019 Budget; changing appropriations to the Department of Education and Early Learning and various budget control levels, and from various funds in the Budget; and ratifying and confirming certain prior acts; all by a 3/4 vote of the City Council.

WHEREAS, by Ordinance 125604, The City of Seattle (“City”) placed before voters “a proposition to lift the limit on regular property taxes under chapter 84.55 RCW and authorize the City to levy additional taxes for up to seven years for the purpose of providing education services designed to improve access to early learning and high-quality preschool, K-12 school and community-based investments, K-12 school health, and post-secondary and job readiness opportunities for Seattle students; implementing exemptions for low income seniors, disabled veterans, and other people who are disabled as defined in RCW 84.36.381; authorizing a creation of a designated fund; directing the application of levy proceeds; establishing eligibility requirements for partners; establishing accountability and reporting structures; providing for the facilitation of communication between the City and stakeholders; providing for partnership agreements with Seattle School District and Seattle Colleges District; requiring a forthcoming Implementation and Evaluation Plan; proposing a ballot title; and authorizing the implementation of agreements for this levy lid lift which will be commonly known as the Families, Education, Preschool, and Promise Levy;” and
WHEREAS, on November 6, 2018, 68.94 percent of the City’s voters approved the proposition; and
WHEREAS, Section 7 of Ordinance 125604 states that proceeds from the Families, Education, Preschool, and Promise Levy (“FEPP Levy”) may be spent only in accordance with an Implementation and Evaluation Plan (“Plan”) approved by ordinance; and
WHEREAS, Section 7 of Ordinance 125604 also states that the Plan will set forth the criteria, measurable outcomes, and methodology by which programs funded by FEPP Levy proceeds will be selected and evaluated; and
WHEREAS, Resolution 31821 establishes the minimum requirements of the Plan to be submitted by the Mayor for Council approval; and
WHEREAS, the Department of Education and Early Learning has developed plans for investments of FEPP Levy proceeds to close the opportunity gap and achieve specific, measurable outcomes for access to and utilization of services across a continuum beginning with high-quality early learning services that prepare children for success in kindergarten, physical and mental health services that support learning, college and job readiness experiences that promote high school graduation, and post-secondary opportunities that promote attainment of a certificate, credential, or degree; and
WHEREAS, the Plan sets forth actions which require that additional funds above the current 2019 Adopted Budget be appropriated; and
WHEREAS, the FEPP Levy Oversight Committee has reviewed and provided input on the Plan as required by Ordinance 125604, and recommends transmittal of the Plan to the City Council; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Families, Education, Preschool, and Promise Levy Implementation and Evaluation Plan (“Plan”), included as Attachment 1 to this ordinance, is approved as required by Section 7 of Ordinance 125604.
Section 2. In order to pay for necessary costs and expenses incurred or to be incurred in 2019, as described in the Plan, for which insufficient appropriations were made due to causes that could not reasonably have been foreseen at the time of making the 2019 Budget, appropriations for the following items in the 2019 Budget are increased from the funds shown as follows:

Section 3. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.
Section 4. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
