AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the Superintendent of Parks and Recreation to enter into a Concession Agreement with EarthCorps to occupy and use a portion of Building 30 at Warren G. Magnuson Park for general office purposes.

WHEREAS, the Department of Parks and Recreation (DPR) needs to lease space in Warren G. Magnuson Park Building 30 to generate revenue and to support the debt service for building renovations; and
WHEREAS, EarthCorps proposes to lease a portion of Building 30 in compliance with all land use codes, historic preservation covenants, and in a manner compatible with the building’s location in an active Seattle park; and
WHEREAS, DPR strives to continuously build, maintain, and preserve parks and trails in the Puget Sound Region; and
WHEREAS, DPR seeks to encourage, awareness, education, and training in areas such as climate change, pollution, and ecological degradation; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation (“Superintendent”), or the Superintendent’s designee, is authorized to execute for and on behalf of The City of Seattle a ten-year Concession Agreement, plus two five-year options to extend, with EarthCorps providing for EarthCorps’ Tenant Improvements and use and occupancy of a portion of Building 30 at Warren G. Magnuson Park. The Concession Agreement shall be substantially in the form of the Warren G. Magnuson Park Building 30 Concession Agreement between The City of Seattle Department of Parks and Recreation and EarthCorps, which is attached to this ordinance as Attachment 1 (the “Concession Agreement”). The Superintendent is authorized to make such minor deletions and revisions to the Concession Agreement as the Superintendent deems to be in the best interest of the City, consistent with the purposes of this ordinance.
Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
