AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the acceptance of a gift of a timber pavilion structure from the Seattle Parks Foundation to be installed in Occidental Square Park for public use.

WHEREAS, the Seattle Parks Foundation, a non-profit organization created in 1999 to provide funds, project support, and advocacy to improve and expand Seattle’s parks and greenspaces, and the Alliance for Pioneer Square, created to lead the implementation of the most recent neighborhood plan, “Pioneer Square 2015,” have offered to construct a timber pavilion in Occidental Square Park, located at 117 S Washington Street, beginning in 2019, and when construction is complete, to gift it to The City of Seattle (“City”); and
WHEREAS, the pavilion will consist of an approximately 13- by 17-foot wood structure that uses and reflects the latest timber technologies and will replace the current kiosk building. The pavilion will function as an information and concierge station for park and Pioneer Square visitors. A large glass roof will sit gracefully above the structure and extend into the park, providing opportunities for play, performance, and classes in a beautiful covered space. The new pavilion will provide for enhanced park activation and will replace a smaller existing kiosk building in need of repairs; and
WHEREAS, the Seattle Parks Foundation is the fiscal sponsor and lead on the project, working in partnership with the Alliance for Pioneer Square; and
WHEREAS, the pavilion will receive all necessary permits including a Certificate of Approval from the Pioneer Square Preservation Board; and
WHEREAS, the Superintendent of Parks and Recreation has given preliminary approval of the proposal; and
WHEREAS, it is the intent of the Department of Parks and Recreation, the Alliance for Pioneer Square, and the Seattle Parks Foundation for the City to take full ownership of, and all rights and interests to, the pavilion free and clear of unnecessary encumbrances; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of the Department of Parks and Recreation (“Superintendent”), or the Superintendent’s designee, is authorized, on behalf of The City of Seattle (“City”), to enter into an agreement with the Seattle Parks Foundation for the construction and installation of a timber pavilion in Occidental Square Park, substantially as described in the letter from the Seattle Parks Foundation attached to this ordinance as Attachment A.
Section 2. Upon completion of construction to the Superintendent’s satisfaction, the Superintendent is authorized to accept a deed of gift of such pavilion on behalf of the City.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
