AN ORDINANCE authorizing the Superintendent of Parks and Recreation to execute and accept from the Washington State Department of Natural Resources on behalf of the City of Seattle a Waterway Permit for Waterway 3 and a Waterway Permit for a portion of Waterway 4, both in Lake Union Park.

WHEREAS, Lake Union Park was constructed in 2010 on lands owned by the City of Seattle and a portion of Waterway 4 owned by the Washington State Department of Natural Resources (DNR) to serve the residents of the City of Seattle and visitors; and
WHEREAS, the Waterway Permit for Waterway 4 has expired and the City and DNR have negotiated a new Waterway permit for the City's use of Waterway 4 property; and
WHEREAS, Waterway 3 is immediately adjacent to Lake Union Park and is utilized by users of Lake Union Park; and
WHEREAS, the City and DNR have negotiated a new Waterway permit for the City's use of Waterway 3 property; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation ("Superintendent") or the Superintendent's designee is hereby authorized on behalf of the City of Seattle ("City") to execute a Waterway Use agreement ("Permit") substantially in the form of Attachment 1 and identified as "Waterway 3 Permit" with the Washington State Department of Natural Resources, authorizing the City to use the property as a public park providing recreational and educational opportunities for all citizens and visitors to the region.
Section 2. The Superintendent or the Superintendent's designee is further authorized on behalf of the City to execute a Waterway Use agreement ("Waterway") substantially in the form of Attachment 2 and identified as "Waterway 4 Use Agreement" with the Washington State Department of Natural Resources, authorizing the City to use the site as a public park providing recreational and...
