AN ORDINANCE authorizing the Mayor to execute an Interlocal Agreement between the City of Seattle, Washington, and the North Highline Fire District that outlines the terms and conditions of payments to the North Highline Fire District to mitigate the financial impacts associated with the City of Seattle’s annexation of the Duwamish Annexation Area.

WHEREAS, on February 10, 2014, the Seattle City Council adopted Resolution 31502 calling for the annexation, by election, of contiguous unincorporated territory referenced as the Duwamish Annexation Area; and
WHEREAS, the North Highline Fire District has the authority to collect property taxes and benefit charges on property in the Duwamish Annexation Area and the proposed annexation of the Duwamish Annexation Area, by The City of Seattle, would result in a loss of these revenues to the North Highline Fire District; and
WHEREAS, the resultant loss of revenue would impose a financial strain on the North Highline Fire District and require it to reduce the level of fire protection and emergency services to the North Highline Fire District’s remaining service area; and
WHEREAS, The City of Seattle and North Highline Fire District have negotiated terms of an interlocal agreement to provide financial assistance to the North Highline Fire District to ensure that adequate resources are available to provide fire protection and emergency services to North Highline Fire District’s remaining service area; and
WHEREAS, on June 15, 2015, the North Highline Fire District Board of Fire Commissioners passed a motion to accept the terms and conditions as presented in the “Framework for Interlocal Agreement between The City of Seattle and North Highline Fire District #11 for the Duwamish Annexation Area” dated June 8, 2015 and revised June 22, 2015; and
WHEREAS, The City of Seattle now desires to enter into an interlocal agreement with the North Highline Fire District that establishes the terms of the agreed-upon mitigation to address the financial impacts associated with Seattle’s annexation of the Duwamish Annexation Area; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Mayor or the Mayor’s designee is authorized to execute, for and on behalf of The City of Seattle, an interlocal agreement with the North Highline Fire District entitled “An Interlocal Agreement Between the City of Seattle, Washington and North Highline Fire District” and substantially in the form attached hereto as attachment 1.
Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
