WHEREAS, in May 2014, State of Washington Court of Appeals decision 31195-3-III ruled that it is permissible for one municipality to tax the revenue of another municipality if the revenue is from activity that is proprietary in character rather than governmental; and
WHEREAS, the City Light Department (City Light) provides electric service to customers in other municipalities outside The City of Seattle under terms specified by franchise agreements; and
WHEREAS, a new Lake Forest Park franchise agreement, adopted by Ordinance 124806, specified terms of the franchise agreement under which City Light provides electric service to customers in Lake Forest Park from May 1, 2015 until April 30, 2030; and
WHEREAS, the aforementioned new franchise agreement allows the city of Lake Forest Park the option to levy a utility tax on the bills of City Light customers within Lake Forest Park on or after January 1, 2016; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Subsection 21.49.020.A of the Seattle Municipal Code, which section was last amended by Ordinance 124818, is amended as follows:
