AN ORDINANCE amending Ordinance 125248 to modify the effective date of certain sections of that ordinance.

WHEREAS, on February 2, 2017 Seattle City Council passed Ordinance 125248, approving updates to environmentally critical area (ECA) regulations; and
WHEREAS, Ordinance 125248 amended several provisions of the City's Shoreline Master Program, which are subject to review by the Washington State Department of Ecology (DOE); and
WHEREAS, it is appropriate that DOE review those amendments simultaneously with future updates to Seattle's Shoreline Management Program;
WHEREAS, Council expects the Seattle Department of Construction and Inspections to propose updates to the Shoreline Management Program in a future bill for Council consideration and possible action; and
WHEREAS, Council is amending the effective date of certain sections of Ordinance 125248 to allow for consolidated DOE review of Shoreline Master Program amendments without postponing the effective date of the remaining sections; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Section 64 of Ordinance 125248 is amended as follows:
Section 64.
A. This ordinance, except for Sections 54, 55, 56, and 57, shall take effect and be in force 30 days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
B. Sections 54, 55, 56, and 57 of this ordinance shall take effect and be in force on whichever is the later of: the effective date of approval and adoption by Ecology; or ((thirty ())30(())) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (((10))) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
