AN ORDINANCE related to a settlement agreement between the City, the Washington State Department of Transportation, King County, and the Alliance for Pioneer Square related to an appeal of the City’s Final Environmental Impact Statement for the Alaskan Way, Promenade, and Overlook Walk projects; approving the agreement and authorizing the Directors of the Office of the Waterfront and the Department of Transportation to implement the terms of the settlement agreement.

WHEREAS, on October 31, 2016, the Seattle Department of Transportation issued a Final Environmental Impact Statement for the Alaskan Way, Promenade, and Overlook Walk projects (FEIS); and

WHEREAS, the Alliance for Pioneer Square (“the Alliance”) filed an appeal of the FEIS, related to several aspects of the FEIS; and

WHEREAS, the Washington State Department of Transportation and King County intervened in that appeal; and

WHEREAS, the City, the Washington State Department of Transportation, King County, and the Alliance have agreed to settle that litigation and that agreement is in the best interest of the City; and

WHEREAS, the City Council adopted the guiding principles for the Central Waterfront in Resolutions 31399, 30724, and 30664, which included reconnecting downtown neighborhoods like Pioneer Square to the Waterfront, creating a Waterfront for all, and improving access and mobility for people and goods; and

WHEREAS, the City remains committed to the guiding principles and implementing a Central Waterfront design that supports pedestrian mobility and pedestrian-scaled place-making; and

WHEREAS, the settlement agreement is subject to approval by the Seattle City Council and the King County Council; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The “Agreement Regarding AWPOW Between the Alliance for Pioneer Square, The City of Seattle, WSDOT, and King County,” attached to this ordinance as Exhibit A, is approved and the Directors of the Office of the Waterfront and the Department of Transportation are hereby authorized to implement its terms, subject to future budget approval by City Council as identified in the agreement.

Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
