AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the execution of a lease agreement with Marina Management, L.L.C. for moorage improvements, maintenance, and operation of the City of Seattle’s public Leschi and Lakewood moorage facilities on Lake Washington; and amending Ordinance 124927, which adopted the 2016 budget, to lift a budget proviso imposed on the Department of Parks and Recreation’s Capital Improvement Program budget in 2016 for the moorage facilities.

WHEREAS, the Department of Parks and Recreation (DPR) owns three public moorage facilities on Lake Washington commonly referred to as Leschi North Moorage, Leschi South Moorage, and Lakewood Moorage; and

WHEREAS, in November 2015, DPR initiated a Request for Proposal (RFP) process seeking proposals from parties that would bring private financing and make complete improvements to the marinas, in addition to being responsible for maintaining and operating the marinas; and

WHEREAS, DPR completed the RFP process in February 2016 and selected Marina Management, L.L.C. as the winning respondent to the RFP; and

WHEREAS, the lease agreement with Marina Management, L.L.C. recognizes and embraces neighborhood character, tenant and community needs, and lays out a plan for coordinating public and private improvements at the moorages in a manner that achieves long-term sustainability of the moorage facilities; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Superintendent of Parks and Recreation, or the Superintendent’s designee, is authorized to execute, on behalf of The City of Seattle, a lease agreement with Marina Management, L.L.C. substantially in the form of the Marina Lease between the City of Seattle Department of Parks and Recreation and Marina Management, L.L.C. attached to this ordinance as Attachment 1.

Section 2.  The restrictions imposed by the following budget proviso that limits spending on the following item are removed because the conditions set forth in the proviso have been satisfied and they are no longer restrictions for any purpose, including those set forth in the 2016 budget, adopted by Ordinance 124927:

“None of the money appropriated in the 2016 budget for the Department of Parks and Recreation’s (DPR) Docks, Piers, Floats, Seawalls, Shorelines BCL may be spent for repair of the Lakewood and Leschi Moorages until DPR submits and the Council approves by ordinance an agreement with a new Lessee/Concessionaire who will operate and make repairs or renovations to these moorages.”

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
