AN ORDINANCE authorizing the Superintendent of Parks and Recreation to execute and accept from the Washington State Department of Natural Resources, on behalf of The City of Seattle, an Aquatic Lands Lease for Seattle’s Waterfront Parks; and ratifying and confirming certain prior acts.

WHEREAS, Seattle’s Waterfront Parks, comprising Piers 57 to 59 and Piers 62 and 63, were built on lands of The City of Seattle and the Washington State Department of Natural Resources (DNR) to serve the residents of and visitors to the city of Seattle; and

WHEREAS, Waterfront Parks’ lease with DNR for Piers 57 to 59 expired in 1993, and the City has occupied the site continuously since that time as a carry-over tenant; and

WHEREAS, Waterfront Parks’ lease with DNR for Piers 62 and 63 expired in 2004, and the City has occupied the site continuously since that time as a carry-over tenant; and

WHEREAS, Pier 62 will be reconstructed in the fall of 2017 as part of Seattle’s Waterfront Plan; and

WHEREAS, Piers 57 to 59 and Pier 63 will be redeveloped in the future part of Seattle’s Waterfront Plan; and

WHEREAS, the City and DNR have negotiated a new lease that will combine the two expired leases and allow for the redevelopment of the piers, as well as provide long-term security for the City’s use of the DNR property; NOW THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Superintendent of Parks and Recreation (“Superintendent”) or the Superintendent’s designee is hereby authorized, on behalf of The City of Seattle (“City”), to execute a lease agreement (“Lease”) with the Washington State Department of Natural Resources, substantially in the form of Attachment 1 to this ordinance and identified as “Aquatic Lands Lease,” authorizing the City to use the property as a public park providing recreational and educational opportunities for all citizens and visitors to the region.

Section 2. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.

 

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
