AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the acceptance of a donation of real property along the Burke-Gilman Trail in northeast Seattle, from the Estate of Jack Allbritton, for open space, park, and recreation purposes.

WHEREAS, The City of Seattle (“City”) is continually acquiring property to expand existing parks and conserve green spaces; and
WHEREAS, the City does not have adequate funding to acquire all the properties worthy of conservation; and
WHEREAS, the City encourages owners of properties that add value to the City’s inventory of parks and green spaces to donate them to the City; and
WHEREAS, the Estate of Jack Allbritton (“Estate”) owns certain real property adjacent to the Burke-Gilman Trail in northeast Seattle (“Property”) and desires to transfer that Property to the City for open space, park, and recreation purposes; and
WHEREAS, it is the intent of both the Seattle Department of Parks and Recreation (DPR) and the Estate for the City to take title, ownership, and all rights and interests to the Property free and clear of unnecessary encumbrances; and
WHEREAS, the Seattle City Charter requires that all acquisition and disposition of real property rights be authorized and accepted by or under authority of ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation (“Superintendent”), or the Superintendent’s designee, is authorized, on behalf of The City of Seattle, to acquire by donation from the Estate of Jack Allbritton the following real property legally described below (“Property”):
Real property in the County of King, State of Washington, described as follows:
THAT PORTION OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 2, TOWNSHIP 25 NORTH, RANGE 4 EAST, WILLAMETTE MERIDIAN, IN KING COUNTY, WASHINGTON LYING BETWEEN THE WEST LINE OF THE ABANDONED RIGHT OF WAY OF THE NORTHERN PACIFIC RAILROAD COMPANY AND A LINE 65 FEET WEST OF AND PARALLEL WITH THE CENTERLINE OF SAID RIGHT OF WAY, AND NORTHERLY OF THE EASTERLY PRODUCTION OF THE NORTH LINE OF LOT 6, BLOCK 8, WESTHAVEN DIVISION NO 2, ACCORDING TO THE PLAT THEREOF, RECORDED IN VOLUME 31 OF PLATS, PAGE 13, IN KING COUNTY, WASHINGTON.
EXCEPT THAT PORTION THEREOF CONVEYED TO THE CITY OF SEATTLE FOR STREET PURPOSES UNDER RECORDING NUMBER 5119248.

Section 2. The Superintendent, or the Superintendent’s designee, is authorized to execute such documents as the Superintendent or designee deems necessary or desirable to accomplish the acquisition consistent with this ordinance, and to accept the deed for the Property by attaching to the deed the Superintendent’s written acceptance thereof, and recording the same.
Section 3. The Property shall be accepted for open space, park, and recreation purposes and placed under the jurisdiction of the Seattle Department of Parks and Recreation.
Section 4. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within 10 days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
