WHEREAS, the Seattle City Council passed Ordinance 112906 granting permission to Gene McKinney to construct and maintain a greenhouse on the south side of Northeast 140th Street, east of Lake City Way, attached to the building at 13758 Lake City Way Northeast for a ten-year term, with two renewable ten-year terms; and
WHEREAS, the use of the structure changed from a greenhouse to an extension of the building located at 13758 Lake City Way Northeast, including a rockery and planter boxes; and
WHEREAS, the permission granted by Ordinance 112906 expired August 9, 2016; and
WHEREAS, Barbara McKinney, the heir to the estate of Gene McKinney, has applied for permission to continue maintaining and operating this building encroachment, including a rockery and planter boxes; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Permission. Subject to the terms and conditions of this ordinance, The City of Seattle ("City") grants permission (also referred to in this ordinance as a permit) to Barbara McKinney, and her successors and assigns as approved by the Director of the Seattle Department of Transportation ("Director") according to Section 14 of this ordinance (the party named above and each such approved successor and assign are referred to as "Permittee"), to maintain and operate a building encroachment, including rockery and planter boxes,...
