AN ORDINANCE relating to the Department of Finance and Administrative Services; authorizing the Director or the Director's designee to execute a non-exclusive sub-surface sewer utility easement and a non-exclusive sub-surface water utility easement under, across, and upon a portion of the property known as Fire Station 28 located at 5968 Rainier Avenue South, Seattle, Washington, to Anne Michelson, an unmarried person, and to the successor owners of the property located at 5970 Rainier Ave South, Seattle, WA.

WHEREAS, The City of Seattle (City) owns the parcel of land commonly known as the Fire Station 28 Property (Property); identified by the address 5968 Rainier Ave South, Seattle; King County Assessor's parcel number 811310-1080; and
WHEREAS, Ordinance 123339 granted a non-exclusive easement for the ingress and egress, over, through, across, and upon a portion of the property known as the Property; and
WHEREAS, a temporary permit allowed existing subsurface utilities serving the Michelson Residence (Residence) identified as 5970 Rainier Ave. South, King County Assessor's parcel number 811310-0100, to remain in place until a permanent easement and location could be identified; and
WHEREAS, the Department of Finance and Administrative Services (FAS) has determined that the only viable location for permanent sewer and water utility easements for the Residence are across the Property; and
WHEREAS, the Seattle Fire Department and FAS have determined that the easements will not interfere with the use or maintenance of the Property; and
WHEREAS, the City desires to grant permanent sewer and water utility easements to Anne Michelson, an unmarried person, and to the successor owners of the Residence; NOW, THEREFORE,
