AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the Superintendent of Parks and Recreation to execute an amended and restated lease between the City of Seattle and Oiselle Running, Inc. to occupy and use a portion of Building 11 at Warren G. Magnuson Park for general office purposes; and superseding the requirements of Ordinance 118477 for the purposes of this ordinance.

WHEREAS, Ordinance 122814 authorized the Superintendent of Parks and Recreation (Superintendent) to execute, for and on behalf of The City of Seattle (City), a master lease agreement for Building 11 at Warren G. Magnuson Park, and superseded Ordinance 118477, adopting Initiative 42, for purposes of Ordinance 122814; and
WHEREAS, after the City terminated the master lease agreement for Building 11, Ordinance 124897 authorized the Superintendent to execute, for and on behalf of the City, a lease agreement with Oiselle Running, Inc. (Oiselle); and
WHEREAS, in December 2015 the City and Oiselle executed a five-year lease (Lease) pursuant to Ordinance 124897 that granted Oiselle the right to occupy and use a portion of Building 11 at Warren G. Magnuson Park for general office and business use; and
WHEREAS, when Oiselle attempted to acquire permits from the Seattle Department of Construction and Inspections, both Oiselle and the City learned that required seismic upgrades in Building 11 had not been complete. Oiselle was unable to acquire permits needed to begin tenant improvements and unable to move into the space; and
WHEREAS, the City expedited funding and implementation of the seismic improvements. This work has now been completed and Oiselle’s premises are ready for occupancy; and
WHEREAS, it is in the parties’ mutual best interest to amend the Lease to allow Oiselle to move into its premises in 2019 and update the Effective, Commencement, and Rent Commencement dates; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of the Department of Parks and Recreation is authorized to execute, for and on behalf of The City of Seattle, a Lease Amendment in substantially the form of Attachment 1 to this ordinance.
Section 2. To the extent that Ordinance 118477 is applicable to the Lease (attached to this ordinance as Attachment 2), the requirements of Initiative 42 (attached to this ordinance as Attachment 3) are superseded.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
