WHEREAS, in July 2017, the Seattle Department of Transportation began a pilot permit program to replace the discontinued Pronto bike share system by allowing private free-floating bike share companies to deploy free-floating bikes on sidewalks Citywide; and

WHEREAS, fees charged to the companies during the pilot covered the costs of issuing and administering the permits and evaluating the bike share pilot; and

WHEREAS, the ongoing free-floating bike share program may evaluate, pilot, and permit other shareable mobility devices to accommodate disabled riders, such as tricycles, handcycles, tandem cycles, and other human-powered or electric-assisted adaptive cycles; and

WHEREAS, the Seattle Department of Transportation intends to expand the free-floating bike share program to 20,000 bicycles, with an allowance of up to an additional 1,000 bicycles per permit to incentivize deployment of adaptive cycles to accommodate disabled riders; and

 WHEREAS, the existing permit administrative fees must be modified to cover the expected costs of administering the ongoing free-floating bike share permit program and its program goals; and

WHEREAS, Section 15.04.074 of the Seattle Municipal Code authorizes and directs the Director of Transportation to prepare and recommend to the City Council fees applicable to street and sidewalk use permits commensurate with the cost of administering, reviewing, issuing, inspecting, and policing permits granted for the uses; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Seattle Department of Transportation (“Department”) Free-Floating Bike Share Program Fee Schedule is adopted as follows:

$260 per hour of review as specified in the Street Use Permit Fee Schedule or as subsequently amended

Administrative Fee per year

If four vendors are granted permits during the initial permit application period:

$250,000 per vendor

 

If three or fewer vendors are granted permits during the initial permit application period:

$50 per permitted bicycle or other adaptive device to accommodate disabled riders, prorated by month

 

If additional vendors are granted permits after the initial permit application period:

$250,000 per vendor, prorated by month, if the vendor deploys 5,000 or more bicycles or other adaptive devices to accommodate disabled riders $50 per permitted device, prorated by month, if the vendor deploys fewer than 5,000 bicycles or other adaptive devices to accommodate disabled riders

Section 2. The Department is authorized to charge lower administrative fees if further analysis demonstrates to the Department that it can cover bike share administration costs for less than the fees authorized in Section 1 of this ordinance.

Section 3. To pay for necessary costs and expenses incurred or to be incurred in 2018, but for which insufficient appropriations were made due to causes that could not reasonably have been foreseen at the time of the making of the 2018 Budget, appropriations for the following items in the 2018 Budget are increased as follows:

Section 4.  No more than $500,000 of the funds appropriated in this ordinance for the Mobility Operations Budget Control Level in the 2018 Budget may be spent on implementing the free-floating bike share program until the Chair of the Sustainability and Transportation Committee files a certification with the City Clerk that the Department of Transportation has provided a plan for direct enforcement of bike-share parking requirements and management of the right-of-way to accommodate disabled pedestrians by creating a parking enforcement program or identifying use of a parking enforcement strategy currently implemented by The City of Seattle.

Section 5. The Department is requested to provide written quarterly reports to City Council through December 31, 2019, on installing designated bike parking associated with the free-floating bike share permit program.

Section 6. The Department is requested to provide a written plan for sidewalk management and safety addressing the increasing use of fast-moving electric-motor devices on sidewalks, to City Council by December 31, 2018.

Section 7. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
