AN ORDINANCE authorizing the Superintendent of Parks and Recreation to execute and accept from the Washington State Department of Natural Resources, on behalf of The City of Seattle, an Aquatic Lands Lease for Andrews Bay; and ratifying and confirming certain prior acts.

WHEREAS, Seattle’s Seward Park, one of the City’s oldest parks, is located on the eastern shore of Andrews Bay in Lake Washington; and

WHEREAS, Andrews Bay is under the jurisdiction of the Washington State Department of Natural Resources (DNR); and

WHEREAS, Andrews Bay serves as short-term moorage for recreational vessels; and

WHEREAS, lack of jurisdictional clarity between DNR and the Seattle Department of Parks and Recreation (DPR) has created problems in the summer months because of the City’s inability to control unruly behavior; and

WHEREAS, the Seattle Harbor Patrol would benefit from having the whole of Andrews Bay be under the management of DPR; and

WHEREAS, DPR and DNR have negotiated a new lease that will allow for the long-term management of Andrews Bay for the benefit of the City’s residents; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Superintendent of Parks and Recreation (“Superintendent”) or the Superintendent’s designee is hereby authorized, on behalf of The City of Seattle (“City”), to execute a lease agreement (“Lease”) with the Washington State Department of Natural Resources, substantially in the form of Attachment 1 to this ordinance and identified as “Aquatic Lands Lease,” authorizing the City to use the property for recreational and educational opportunities for all citizens and visitors to the region.

Section 2. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.

 

 

 

Section 3. This ordinance shall take effect and be in force thirty (30) days after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
