AN ORDINANCE vacating the alley in Block 22, Brooklyn Addition and additional adjacent right-of-way, and the alley in Block 23, Brooklyn Addition, on the petition of the University of Washington (Clerk File 310162 and Clerk File 310163).

WHEREAS, the University of Washington (“Petitioner”) filed a petition under Clerk File 310162 to vacate the alley in Block 22, Brooklyn Addition to Seattle between Northeast 41st Street and Northeast Campus Parkway, being the alley bounded by Northeast 41st Street, Brooklyn Avenue Northeast, Northeast Campus Parkway, and 12th Avenue Northeast, and the south five feet of Lot 21, Block 22, Brooklyn Addition and the southeast corner of Lot 4, Block 22, Brooklyn Addition; and

WHEREAS, the Petitioner filed a petition under Clerk File 310163 to vacate the alley in Block 23, Brooklyn Addition to Seattle between Northeast Campus Parkway, University Way Northeast, Northeast 40th Street, and Brooklyn Avenue Northeast; and

WHEREAS, following an April 13, 2010 public hearing on the petitions, the Seattle City Council (“City Council”) conditionally granted both petitions on April 19, 2010; and

WHEREAS, a Property Use and Development Agreement recorded on June 11, 2018, with the King County Recorder’s Office under Recording No. 20180611001256 commits the Petitioner and their successors to maintain ongoing public-benefit obligations required as part of the vacation; and

WHEREAS, the University of Washington, as a Washington State agency, does not pay vacation fees pursuant to Section 15.62.090 of the Seattle Municipal Code; and

WHEREAS, the University of Washington has met all conditions imposed by the City Council in connection with the vacation petitions; and

WHEREAS, vacating the alley in Block 22, Brooklyn Addition to Seattle between Northeast 41st Street and Northeast Campus Parkway, being the alley bounded by Northeast 41st Street, Brooklyn Avenue Northeast, Northeast Campus Parkway, and 12th Avenue Northeast, and the south five feet of Lot 21, Block 22, Brooklyn Addition and the southeast corner of Lot 4, Block 22, Brooklyn Addition; and the alley in Block 23, Brooklyn Addition to Seattle between Northeast Campus Parkway, University Way Northeast, Northeast 40th Street, and Brooklyn Avenue Northeast in the University District neighborhood is in the best interests of the public; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The alley in Block 22, Brooklyn Addition to Seattle between Northeast 41st Street and Northeast Campus Parkway, being the alley bounded by Northeast 41st Street, Brooklyn Avenue Northeast, Northeast Campus Parkway, and 12th Avenue Northeast, and the south five feet of Lot 21, Block 22, Brooklyn Addition and the southeast corner of Lot 4, Block 22, Brooklyn Addition; and the alley in Block 23, Brooklyn Addition to Seattle between Northeast Campus Parkway, University Way Northeast, Northeast 40th Street, and Brooklyn Avenue Northeast in the University neighborhood of Seattle described below is vacated:

Block 22:

The alley in Block 22, Brooklyn Addition to Seattle, according to the plat recorded in Volume 7, page 32, in King County, Washington, being alley abutting Lots 1 through 4 and Lots 21 through 24 of said Block and bounded by Northeast 41st Street, Brooklyn Avenue Northeast, Northeast Campus Parkway, 12th Avenue Northeast; together with

The south 5 feet of Lot 21 in Block 22, Brooklyn Addition to Seattle, according to the plat recorded in Volume 7 of Plats, page 32, in King County, Washington; together with

That portion of Lot 4, in Block 22, Brooklyn Addition to Seattle, according to the plat recorded in Volume 7, page 32, in King County, Washington, being described as follows: beginning at the southeast corner of Lot 4; thence north along the east line of said Lot a distance of 18 feet; thence southwesterly to a point of the south line of said Lot and 6.71 feet west of the point of beginning; thence east 6.71 feet to the point of beginning. 

Block 23:

The alley in Block 23, Brooklyn Addition to Seattle, according to the plat recorded in Volume 7, page 32, in King County, Washington, being the alley abutting Lots 9 through 12 and Lots 13 through 16 of said Block and bounded by Northeast Campus Parkway, University Way Northeast, Northeast 40th Street, and Brooklyn Avenue Northeast.

Section 2. The Property Use and Development Agreement, King County Recording Number 20180611001256, attached as Attachment A to this ordinance, is accepted.

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
