A RESOLUTION setting the public hearing on the petition of Seattle City Light for the vacation of a portion of Broad Street between Harrison Street and Taylor Avenue North adjacent to Block 66, D.T. Denny’s Park Addition to North Seattle, which is the block bounded by Harrison Street, 6th Avenue North, Thomas Street, Taylor Avenue North, and Broad Street in the Uptown Urban Center neighborhood area of Seattle, according to Chapter 35.79 of the Revised Code of Washington, Chapter 15.62 of the Seattle Municipal Code, and Clerk File 314387.

WHEREAS, Seattle City Light has filed a petition with the City Council to vacate public property; and

WHEREAS, the petition is signed by the owner of more than two-thirds of the property abutting on the subject area; NOW, THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE THAT:

Section 1. A hearing by the Seattle City Council for the petition to vacate a portion of Broad Street between Harrison Street and Taylor Avenue North has been scheduled to take place during the Council’s Sustainability and Transportation Committee meeting on Tuesday, December 4, 2018, starting at 2:00 p.m., in the City Council Chambers, Floor 2, City Hall. The Sustainability and Transportation Committee of the City Council will consider the petition when Clerk File 314387 is before the committee according to the Committee’s agenda.

The City Clerk is directed to give the notice of the hearing in the manner provided by law. A map, indicating the property described in the petition, shall be affixed to and become part of the notice that shall be posted by the street vacation petitioner in a conspicuous place on the right-of-way sought to be vacated.

Section 2. The hearing will provide opportunity for comments on the vacation of a portion of Broad Street between Harrison Street and Taylor Avenue North, described as:

That portion of the Southeast Quarter of the Southwest Quarter of Section 30, Township 25 North, Range 4 East, Willamette Meridian;

Also being a portion of existing Broad Street right-of-way, originally dedicated as Lake Avenue per D.T. Denny’s Park Addition to North Seattle, according to the plat thereof recorded in Volume 2 of Plats, page 46, records of King County, Washington, more particularly described as follows:

That portion of said Broad Street right-of-way lying adjacent to Block 66 of said plat and bounded on the north by the north line of said Block extended westerly, bounded on the west by the westerly line of said Block extended northerly, and bounded on the southeast by the northwest line of said Block.

Or, in the alternative, to vacate any portion of this right-of-way as described above, reserving to The City of Seattle all necessary slope rights including cuts or fills on the above-described former right-of-way abutting on the property after the vacation, and further reserving to The City of Seattle the right to reconstruct, maintain, and operate any existing overhead or underground utilities in the property until the beneficiaries of the vacation arrange with the owners for their removal.
