AN ORDINANCE authorizing the Superintendent of Parks and Recreation to execute and accept from the Washington State Department of Natural Resources on behalf of The City of Seattle a waterway permit for Waterway 3A in the Washington Park Arboretum.

WHEREAS, Waterway 3A is located in the Washington Park Arboretum; and
WHEREAS, Waterway 3A is owned by Washington State Department of Natural Resources (DNR) and managed by Seattle Department of Parks and Recreation (DPR); and
WHEREAS, the waterway permit for Waterway 3A has expired and the DPR and DNR have negotiated a new waterway permit for the City's use of Waterway 3A property; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation ("Superintendent") or the Superintendent's designee is hereby authorized on behalf of The City of Seattle ("City") to execute a waterway use agreement ("Permit") substantially in the form of Attachment 1 to this ordinance and identified as "Waterway 3A DNR Permit" with the Washington State Department of Natural Resources, authorizing the City to use the property as a public park providing recreational and educational opportunities for all citizens and visitors to the region.
Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within 10 days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
