AN ORDINANCE related to Yesler Crescent Improvements; amending Ordinance 125724, which adopted the 2019 budget including the 2019-2024 Capital Improvement Program (CIP); lifting a proviso imposed on the Department of Parks and Recreation’s Building for the Future Budget Summary Level in 2019 for improvements to the Yesler Crescent Corridor adopted in the 2019 budget; changing appropriations to various departments and budget control levels, and from various funds in the Budget; and revising project allocations for certain projects in the 2019-2024 CIP; and ratifying and confirming certain prior acts.

WHEREAS, the 2019 Adopted Budget included funding to be used exclusively for planning, design and activation of the Yesler Crescent Corridor which includes City Hall Park, Dilling Way and Prefontaine Place; and

WHEREAS, the 2019 Proposed Budget included $500,000 to fund improvements to the Yesler Crescent Corridor to enhance circulation and increase park activation and preservation based on safety issues in and around City Hall Park.  City Council then added $470,000 in King County Levy Funding to the project and imposed a proviso stating that no more than $75,000 of the money appropriated in the 2019 budget may be spent until authorized by a future ordinance; and

WHEREAS, the City Council placed a proviso on $895,000 in the 2019 Adopted Budget for the Seattle Parks and Recreation’s Building for the Future Budget Summary Level, all of which is to be spent solely on the Yesler Crescent Improvement project once authorized by future ordinance and following City Council approval of a Parks and Recreation spending plan; and

WHEREAS, the Executive has presented to the Council a spending plan in response to Green Sheet 10-7-B-1 and the proviso imposed by Ordinance 125724 regarding the Yesler Crescent Improvements project, and, through this response and legislation, has satisfied the terms of the budget proviso; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The restrictions on 2019 Building for the Future Budget Summary Level for improvements to Yesler Crescent Corridor proviso are removed because the conditions set forth in the proviso have been satisfied and are no longer restrictions for any purpose, including those set forth in Ordinance 125724.

"No more than $75,000 of the money appropriated in the 2019 budget for the Department of Parks and Recreation's Building for the Future BSL may be spent for the Yesler Crescent Improvements project (Project ID # MC-PR-21012 in the 2019-2024 Capital Improvement Program) until authorized by a future ordinance. It is anticipated that such a future ordinance will not be passed until the Department of Parks and Recreation submits to the Finance and Neighborhoods Committee or its successor committee a set of recommendations, including a spending plan for this project."

Allocation modifications for the Seattle Department of Transportation in this section shall operate for the purposes of increasing or decreasing the base for the limit imposed by subsection 4(c) of Ordinance 125724.

Section 4.  Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.

 

Section 5. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
