AN ORDINANCE related to appropriations for the Office of Arts & Culture; amending Ordinance 125724, which adopted the 2019 Budget; and lifting a proviso imposed on the Office of Arts & Culture’s Cultural Space Budget Control Level by Seattle City Council Green Sheet 2-5-B-1-2019.

WHEREAS, the 2019 Adopted City of Seattle Budget included $150,000 of capital funding for Town Hall; and
WHEREAS, this funding was intended to support the construction and renovation of Town Hall; and
WHEREAS, the City Council (“Council”) adopted a proviso on this funding that no money could be spent until authorized by future ordinance; and
WHEREAS, Council anticipated that authority would not be granted until the Executive had negotiated and approved the proposed public benefit package; and
WHEREAS, in conjunction with the Office of Arts and Culture, Council has negotiated and approved a public benefit agreement with Town Hall; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The restrictions imposed by the following budget proviso, which limit spending on the following items, are removed because the conditions set forth in the proviso have been satisfied and they are no longer restrictions for any purpose, including those set forth in Attachment A as referenced in Section 1(b) of Ordinance 125724:

“None of the money appropriated in the 2019 budget for the Office of Arts and Culture’s Cultural Facilities BSL may be spent for the Town Hall project until authorized by future ordinance. Council anticipates that such authority will not be granted until the Executive provides Council with negotiated contracts detailing the public benefits that will be delivered by each partner agency in exchange for the City funding.” |

Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
