AN ORDINANCE amending Ordinance 125724, which adopted the 2019 Budget; changing appropriations to various departments and budget control levels, and from various funds in the Budget; and ratifying and confirming certain prior acts; all by a 3/4 vote of the City Council.

WHEREAS, collective bargaining agreements between The City of Seattle and unions belonging to the Coalition of City Unions expired on December 31, 2018; and

WHEREAS, collective bargaining has led to tentative and ratified agreements between The City of Seattle and the unions belonging to the Coalition of City Unions, including provisions for Annual Wage Increases; and

WHEREAS, collective bargaining has also led to Annual Wage Increase (AWI) agreements with other bargaining units; and

WHEREAS, it has been the City’s policy to extend such increases in compensation to non-represented employees; and,

WHEREAS, consistent with that policy, Council Bill 119714 authorized the extension of the AWI to non-represented employees for 2019, 2020 and 2021; and

WHEREAS, during the development of the 2019 Adopted Budget, appropriations were not made for the 2019 Annual Wage Increase due to uncertainty on the percentages and instead planning reserves were established in all funds; and

WHEREAS, in 2017, the Washington State Legislature passed Senate Bill 5975 establishing a paid family medical leave insurance program, which provides wage supplementation to eligible individuals who work in Washington State who qualify for the program; and

WHEREAS, the Washington State paid family medical leave is funded by premiums set at 0.4 percent of payroll for 2019, of which approximately 1/3 must be paid by the employer and 2/3 may be paid by the employee; and

WHEREAS, The City of Seattle as an employer has agreed to pay the full amount of these premiums for all municipal employees in the first year, 2019, and so funds must be appropriated to departments to cover this obligation; and

WHEREAS, The City of Seattle administers payroll withholding for employee contributions to the City of Seattle Voluntary Deferred Compensation Plan; and

WHEREAS, for a period of time between 2012 and 2018 withholding was not reactivated for 126 employees after they returned to work from being on Industrial Insurance (Workers Compensation) leave, thus, these employees received full wages but made no contributions to their Deferred Compensation Plan accounts; and

WHEREAS, the Internal Revenue Service’s Voluntary Fiduciary Correction Program (VFCP)  guidance recognizes that employees benefited by receiving the missed contributions as wages during this time, but that their Deferred Compensation Plan accounts did not receive the interest earnings that they otherwise would have had the withholdings and contributions been made; and

WHEREAS, the City has elected to remedy the missing contributions in accordance with the IRS’s VFCP guidance, which calls for a contribution by the employer into each affected employee’s Deferred Compensation Plan account an amount equal to 50 percent of missed contributions plus interest as determined using the IRS’s VFCP calculator; and

WHEREAS, those affected Police Officers eligible for a City match of their contributions, the City would also contribute 100 percent of the missed City match plus interest; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. In order to pay for necessary costs and expenses incurred or to be incurred in 2019, but for which insufficient appropriations were made in the 2019 Adopted Budget due to causes which could not reasonably have been foreseen at the time of the making of the budget, appropriations for the following items in the 2019 Budget are increased from the funds shown, as follows:

Unspent funds so appropriated shall carry forward to subsequent fiscal years until they are exhausted or abandoned by ordinance.

Section 2. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.

 

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
