AN ORDINANCE relating to appropriations for the Office for Civil Rights; amending Ordinance 126000, which adopted the 2020 Budget; and lifting provisos.

WHEREAS, The City of Seattle’s 2020 Adopted Budget included $170,000 of General Fund allocation for Criminal Justice Realignment and community engagement; and

WHEREAS, this funding was intended to support community engagement and racial equity analysis around the Mayor’s “High Barrier Work Group” proposals; and

WHEREAS, the City Council (“Council”) adopted provisos on this funding that no money could be spent until authorized by future ordinance; and

WHEREAS, in light of the COVID-19 pandemic and recent community organizing around the importance of community-centered decisions around the realignment of the criminal legal system highlights the need for the City to invest in infrastructure that allows for community to shape policies moving forward; and

WHEREAS, Black, Indigenous, People of Color (BIPOC) communities and systems-impacted communities are disproportionately impacted by the onset of COVID-19 in the Seattle-King County region; and 

WHEREAS, the City has a commitment to addressing the needs of the most vulnerable communities in this period of the City’s history, especially BIPOC communities; and

WHEREAS, the Office for Civil Rights developed a spending plan and submitted the spending plan to the Council; and

WHEREAS, the Office for Civil Rights intends to work in conjunction with the Office of Economic Development and the Legislative Department to conduct community engagement sessions to support said vulnerable communities; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The restrictions imposed by the following budget provisos, which limit spending on the following items, are removed because the conditions set forth in the provisos have been satisfied and they are no longer restrictions for any purpose:

“Of the appropriation in the 2020 budget for the Office for Civil Rights, $30,000 is appropriated solely for community engagement sessions led by the Office for Civil Rights and the Legislative Department and may be spent for no other purpose. These funds are intended to support the Council’s criminal legal system alignment work to engage with stakeholders, including persons currently or formerly incarcerated and communities most impacted by the criminal legal system, and staff in relevant City departments, including the City Attorney’s Office, Seattle Municipal Court, and the Criminal Justice Equity Team. Furthermore, none of the money so appropriated may be spent until authorized by future ordinance. Council anticipates that such authority will not be granted until the Office for Civil Rights provides to the chair of the committee with jurisdiction over public safety a plan for how the money will be spent for this purpose.”

“Of the appropriation in the 2020 budget for the Office for Civil Rights, $140,000 is appropriated solely for partnership, outreach, and engagement related to criminal legal system alignment, strategic plan development, and implementation efforts, including the work described in Council Budget Action CJ-2-B2, Council Budget Action CJ-3-A-2, and Statement of Legislative Intent CJ-21-A-2 and may be used for no other purpose. Furthermore, none of the money so appropriated may be spent until authorized by future ordinance. Council anticipates that such authority will not be granted until the Office for Civil Rights provides to the chair of the committee with jurisdiction over public safety a plan for how the money will be spent for this purpose.”

Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
