A RESOLUTION setting the public hearing on the petition of Central Puget Sound Regional Transit Authority (hereafter Sound Transit) for the vacation of the south 115.78 feet portion of the alley in Block 3, Shelton’s Addition to the City of Seattle in the block bounded by NE 45th Street, Roosevelt Way NE, NE 47th Street, and 11th Avenue NE, in the University Community Urban Center area of Seattle, according to Chapter 35.79 of the Revised Code of Washington, Chapter 15.62 of the Seattle Municipal Code, and Clerk File 314496.

WHEREAS, Sound Transit has filed a petition with the City Council to vacate public property; and

WHEREAS, the petition is signed by the owners of more than two-thirds of the property abutting on the subject area; NOW, THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE THAT:

Section 1. A hearing by the Seattle City Council for the petition to vacate a portion of the alley in Block 3, Shelton’s Addition to the City of Seattle has been scheduled to take place during the Council’s Transportation and Seattle Public Utilities Committee meeting on Tuesday, August 15, 2023, starting at 9:30 a.m., in the City Council Chambers, Floor 2, City Hall. The Transportation and Seattle Public Utilities Committee will consider the petition when Clerk File 314496 is before the committee according to the Committee’s agenda.

The City Clerk is directed to give the notice of the hearing in the manner provided by law. A map, indicating the property described in the petition, shall be affixed to and become part of the notice that shall be posted by the street vacation petitioner in a conspicuous place on the right-of-way sought to be vacated.

Section 2. The hearing will provide opportunity for comments on the vacation of a portion of the alley in Block 3, Shelton’s Addition to the City of Seattle in the block bounded by NE 45th Street, Roosevelt Way NE, NE 47th Street, and 11th Avenue NE, described as follows (and fully described in Clerk File 314496):

SOUTHERN PORTION OF THE ALLEY IN BLOCK 3 BOUNDED BY NE 45TH STREET, ROOSEVELT WAY NE, NE 47TH STREET, AND 11TH AVENUE NE, WHERE THE ALLEY SPLITS PARCEL 7733600155, A LENGTH OF APPROXIMATELY 116 FEET.

Or, in the alternative, the hearing will provide opportunity for comments on the vacation of any portion of this right-of-way as described above, reserving to The City of Seattle all necessary slope rights including cuts or fills on the above-described former right-of-way abutting on the property after the vacation, and further reserving to The City of Seattle the right to reconstruct, maintain, and operate any existing overhead or underground utilities in the property until the beneficiaries of the vacation arrange with the owners for their removal.
