AN ORDINANCE relating to city-owned property under the jurisdiction of the Seattle Department of Transportation in Blocks 2 and 7, Steel Plant Addition to the City of Seattle, Block 6, Smith’s Replat of Lots 11 to 20 Block 1 Steel Plant Addition to the City of Seattle, and Blocks 54 and 55, Homecroft Addition to the City of Seattle; designating the properties for street purposes; and laying off, opening, widening, extending, and establishing portions of Delridge Way Southwest, Southwest Orchard Street, and Dumar Way Southwest.

WHEREAS, the City accepted property in Lot 1, Block 7, Steel Plant Addition to the City of Seattle; Lots 2 and 4, Block 55, Homecroft Addition to the City of Seattle; and Lot 19, Block 2, Steel Plant Addition to the City of Seattle for general corporate purposes pursuant to Ordinance 91075 passed in 1962, and placed the property under the jurisdiction of the Seattle Department of Transportation, formerly known as the City Engineer (“SDOT”); and

WHEREAS, the South 104.4 feet of the North 204.4 feet of Lot 1, Block 7, Steel Plant Addition to the City of Seattle (the “Tax Property”), which was not included with the property accepted in Ordinance 91075, was acquired from King County to satisfy unpaid taxes and subsequently purchased by the City of Seattle in 1951 pursuant to Ordinance 79972; and

WHEREAS, the Westerly ten foot strip of the Tax Property was transferred to SDOT’s jurisdiction in 1960 and designated for street purposes pursuant to Ordinance 89301 to widen Delridge Way; the remainder of the Tax Property was transferred to SDOT’s jurisdiction pursuant to Ordinance 90840 in 1962 in connection with the proposed Sound Way improvement, but was not designated for street purposes or laid off as right-of-way; and   

WHEREAS, the City accepted property in Lots 1, 2, and 4, Block 6, Smith’s Replat of Lots 11 to 20 Block 1 Steel Plant Addition to the City of Seattle for general corporate purposes pursuant to Ordinance 92394 passed in 1963, and placed the property under SDOT’s jurisdiction; and

WHEREAS, the City accepted property in Lot 8, Block 54, Homecroft Addition to the City of Seattle for general municipal purposes pursuant to Ordinance 70216 passed in 1940, and placed the property under SDOT’s jurisdiction in 1962 pursuant to Ordinance 90895; and

WHEREAS, SDOT has identified the portions of these properties that are necessary to widen Delridge Way Southwest, Southwest Orchard Street, and Dumar Way Southwest; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1.  Delridge Way Southwest is hereby laid off, opened, widened, extended, and established across the following described property:

DEDICATION A:

 

That portion of Lot 1, Block 7, Steel Plant Addition to the City of Seattle, according to the plat thereof recorded in Volume 11 of Plats, Page 90, records of King County, Washington, lying westerly of a line parallel with and 49.00 feet easterly of the following described line:

 

Beginning at the northwest corner of Lot 19 of said Block 7; 

 

Thence along the westerly extension of the north line of said Lot 19, North 89°44’25” West 34.87 feet to the monumented line of Delridge Way SW as described within the City of Seattle Field Book Number 2838; 

 

Thence along said monumented line, South 04°57’22” West 435.85 feet to the intersection of the monumented line of SW Orchard Street as described in said Field Book; 

 

Thence continuing along said monumented line of Delridge Way SW, South 04°57’22” West 673.40 feet; 

 

Thence South 12°31’13” East 227.15 feet;

 

Excepting therefrom the North 100.00 feet of said Lot 1.

 

Containing: 5,269 square feet, more or less.

 

Portion of King County parcel numbers:  798540-0280 and 798540-0290.

DEDICATION B:

The westerly 18.00 feet of the following described property:

 

Lot 2, except the south 10 feet, as measured along the east line thereof, all of Lot 1 and all of Lot 4, Block 6, Smith’s Replat of Lots 11 to 20, Block 1, Steel Plant Addition, according to the plat thereof recorded in Volume 17 of Plats, Page 23, records of King County, Washington.

 

Containing: 2,142 square feet, more or less.

 

Portions of King County parcel number: 783180-0500.

 

DEDICATION C:

That portion of Lot 19, Block 2 of Steel Plant Addition to the City of Seattle, lying northeasterly of Delridge Way Southwest, except portion thereof lying south of a line 210 feet north of and parallel with the south line of said lot;

Containing: 3,001 square feet more or less.

Section 2.  Southwest Orchard Street is hereby laid off, opened, widened, extended, and established across the following described property:

DEDICATION D:

The southeasterly 10.00 feet of Lot 2 and the southerly 10.00 feet of the east half of Lot 4, Block 55, Homecroft Addition to the City of Seattle, according to the plat thereof recorded in Volume 24 of Plats, Page 42, records of King County, Washington, as measured along the southeasterly line of said Block 55;

Together with that portion of said east half of Lot 4, lying southerly of a line parallel with and 35.00 feet northerly of the following described line:

Beginning at the northwest corner of Lot 19, Block 7, Steel Plant Addition to the City of Seattle, according to the plat thereof recorded in Volume 11 of Plats, Page 90, records of said King County; 

Thence along the westerly extension of the north line of said Lot 19, North 89°44’25” West 34.87 feet to the monumented line of Delridge Way SW as described within the City of Seattle Field Book Number 2838; 

Thence along said monumented line, South 04°57’22” West 435.85 feet to the monumented line of SW Orchard Street as described in said Field Book; 

Thence along said monumented line, South 83°20’28” East 519.34 feet to the beginning of a tangent curve to the right and having a radius of 300.00 feet; 

Thence along said curve easterly 328.29 feet through a central angle of 62°41’57”.

Containing: 5,937 Square feet, more or less.

Section 3.  Dumar Way Southwest is hereby laid off, opened, widened, extended, and established across the following described property:

DEDICATION E:

That portion of Lot 8, Block 54, Homecroft Addition to the City of Seattle, according to the plat thereof recorded in Volume 24 of Plats, Page 42, records of King County, Washington, lying northerly of a line parallel with and 35.00 feet southerly of the following described line: 

Beginning at the northwest corner of Lot 19, Block 7, Steel Plant Addition to the City of Seattle, according to the plat thereof recorded in Volume 11 of Plats, Page 90, records of said King County; 

Thence along the westerly extension of the north line of said Lot 19, North 89°44’25” West 34.87 feet to the monumented line of Delridge Way SW as described within the City of Seattle Field Book Number 2838; 

Thence along said monumented line, South 04°57’22” West 435.85 feet to the monumented line of SW Orchard Street as described in said Field Book;

Section 4.  This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
