AN ORDINANCE relating to the Arterial Asphalt and Concrete Program Phase II; accepting a deed for street purposes for certain real property in Block 2, Public Benefit Subdivision of Tract 17, Georgetown; laying off, opening, widening, extending, establishing, and designating the property for street purposes; placing the real property conveyed by such deed under the jurisdiction of the Seattle Department of Transportation; and ratifying and confirming certain prior acts.

WHEREAS, the Arterial Asphalt and Concrete Program Phase II (AAC Program) invests in and maintains Seattle’s 1,547 lane miles of arterial streets by extending their useful life through resurfacing and reconstruction projects; and
WHEREAS, the Seattle Department of Transportation (SDOT) uses a pavement management system to track the condition of arterial street pavement to develop maintenance needs, establish priorities, and select the streets to be rehabilitated each year; and
WHEREAS, South Michigan Street, along with several blocks of Corson Avenue South and a block of South Bailey Street (Streets), are all heavily traveled roadways in the Georgetown community that are showing the wear and tear of use; and
WHEREAS, SDOT is repaving the Streets to repair the potholes and cracks in the Streets relating to the Georgetown Arterial Paving Project, a project under the AAC Program; and
WHEREAS, before repaving the Streets, SDOT is grinding off a two-inch layer of the existing asphalt to evaluate the underlying road, installing new storm drains where water currently ponds, and replacing sidewalks and curb ramps; and
WHEREAS, the AAC Program follows federal accessibility guidelines that require installation of curb ramps in conjunction with paving projects; and
WHEREAS, property acquisition was necessary to upgrade the existing curb ramp at the north corner of Corson Avenue South and South Harney Street to meet the federal accessibility requirements of the Americans with Disabilities Act; and
WHEREAS, maintaining our arterial streets is important to the continued economic viability and livability of Seattle; and
WHEREAS, the Seattle City Charter requires that all acquisition of real property be accepted by or under authority of ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Deed for Street Purposes from 6008 Corson LLC, a Washington limited liability company, dated May 1, 2017 and recorded under King County Recording Number 20170523000367, which is attached as Attachment A and incorporated into this ordinance, is accepted for street purposes, placed under the jurisdiction of the Department of Transportation, and laid off, opened, widened, extended, and established as right-of-way (a portion of tax parcel number 692070-0060).
Section 2. Any act consistent with the authority of this ordinance taken prior to its effective date is ratified and confirmed.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
