BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

ADOPTION OF NEW CODE

Section 1. To the extent listed in Section 22.600.020 of the Seattle Municipal Code as amended by this ordinance, and with a copy on file with the City Clerk in the Clerk File listed in Section 22.600.020, the following code is adopted by reference, with additional chapters and amendments to the code in the listed attachment to this ordinance:

Section 2. Section 22.600.020 of the Seattle Municipal Code, last amended by Ordinance 125392, is amended as follows:

22.600.020 Seattle Fire Code

The Seattle Fire Code consists of:

A. The 2018 International Fire Code, along with Appendices A, B, D, E, F, G, H, and I, ((all as published by the International Code Council, Inc., one)) a copy of which is filed with the City Clerk in Clerk File ((319993)) 321862; and

B. ((The amendments)) Amendments to the ((2015)) 2018 International Fire Code and to Appendices A, B, D, E, F, G, H, and I, adopted by ((the City Council by)) ordinance.

REPEAL OF OLD CODE AND TRANSITION PROVISIONS

Section 3. The following ordinances or sections of ordinances, either adopting or amending older editions of the Seattle Fire Code, are repealed: Section 1 and Sections 3 through 35 of Ordinance 125138, Section 1 of Ordinance 125392, and Sections 1 through 9 of Ordinance 125948.

SEATTLE MUNICIPAL CODE CLEANUP AND CORRECTIONS

Section 4. Section 3.02.125 of the Seattle Municipal Code, last amended by Ordinance 126189, is amended as follows:

3.02.125 Hearing Examiner filing fees

A. The filing fee for a case before the City Hearing Examiner is $85, with the following exceptions:

Section 5. Section 22.602.090 of the Seattle Municipal Code, last amended by Ordinance 125707, is amended as follows:

22.602.090 Fees for filing testing documentation for fire protection systems and emergency responder radio coverage systems

The Fire Chief or the Fire Chief’s designee shall collect a $30 fee for processing documentation pertaining to required testing of fire protection systems and emergency responder radio coverage systems in accordance with Administrative Rule 9.02, “Inspection, Testing, ((and)) Maintenance and Reporting Requirements for Fire Protection Systems and Emergency Responder Radio Amplification Systems,” ((,)) and Administrative Rule 9.04, “Impaired Fire Protection Systems and Emergency Responder Radio Amplification Systems,” ((,)) as required by Seattle Fire Code Section 901.6.1, Standards; ((,)) Section ((901.6.2)) 901.6.3, Records; ((,)) and Section 510.6.1, “Testing and Proof of Compliance.” ((.)) Those test reports that are submitted more than 13 days past the time limitations specified in Administrative Rule 9.02, “Inspection, Testing, ((and)) Maintenance and Reporting Requirements for Fire Protection Systems and Emergency Responder Radio Amplification Systems,” ((,)) shall be subject to a $10 per test report late fee. Test filing fees and late fees shall be payable by the person responsible for performing the systems testing. For purposes of this Section 22.602.090, person has the same meaning as defined in the Seattle Fire Code as constituted pursuant to Section ((22.602.020)) 22.600.020. The Fire Chief shall have the authority to enter into a contract with a third party vendor for purposes of collecting, organizing, categorizing and tracking compliance with Administrative Rules 9.01, 9.02, and 9.04, and for collecting the fees imposed by this Section 22.602.090. The third-party vendor shall be entitled to retain that portion of the fees that represents compensation for the vendor’s services in accordance with the terms of the contract, and shall remit the remainder to the Department.

SEVERABILITY, RATIFY-AND-CONFIRM, AND EFFECTIVE DATE CLAUSES

Section 6. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance, or the invalidity of its application to any person or circumstance, does not affect the validity of the remainder of this ordinance or the validity of its application to other persons or circumstances.

Section 7. Any act relating to the review and processing of permits and permit applications consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.

 

Section 8. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
