AN ORDINANCE related to the City Light Department and the Department of Parks and Recreation; declaring certain real property rights surplus to the needs of the City Light Department; and transferring jurisdiction of the former Lakewood Substation from the City Light Department to the Department of Parks and Recreation for open space, park, and recreation purposes.

WHEREAS, the City’s former Lakewood Substation (“Lakewood Property”) has been redeveloped as part of the City’s Genesee Park and Playfield, and such development requires a transfer of jurisdiction from the City Light Department (“City Light”) to the Department of Parks and Recreation (“Parks”) and a reimbursement by Parks to the City Light Fund of the fair market value of the Lakewood Property; and

WHEREAS, City Light and Parks have determined the fair market value of the Lakewood Property to be $210,000; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Pursuant to provisions of RCW 35.94.040 and after public hearing, the property commonly known as the former Lakewood Substation (“Lakewood Property”), legally described below, is declared no longer needed for The City of Seattle’s electric utility purposes and surplus to the City’s electric utility needs:

The East 80 feet of Lots 13, 14 and 15, Block 19, Lakewood, a Replat of Maynard’s Lake Washington Addition, as recorded in Volume 10 of Plats, page 46, in King County, Washington; AND the West half of vacated 44th Avenue South adjoining said Lots 13, 14 and 15; SUBJECT to an easement for storm drainage over the North 11 feet of said property.

Section 2. Jurisdiction over the Lakewood Property is hereby transferred from the City Light Department (“City Light”) to the Department of Parks and Recreation, upon payment of $210,000 to the City Light Fund (41000) from the Parks Capital Fund (33140).

Section 3. Notwithstanding the transfer of jurisdiction, City Light shall remain responsible for all costs and expenses for response, removal, or other remedial action, including disposal, of any hazardous substance in or on the Lakewood Property or improvements thereon caused by City Light’s use, occupation, or operation of the Lakewood Property.

Section 4. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
