COUNCIL BILL __________________

title

AN ORDINANCE relating to the Pike Place Market, authorizing a renewal of the agreement with the Pike Place Market Preservation and Development Authority commonly known as the “Hildt-Licata Agreement,” for a term of ten years.

body

WHEREAS, as authorized by Ordinance 111236, in 1983 the Pike Place Market Preservation and Development Authority (PDA) and The City of Seattle (“City”) entered into an agreement commonly known as the “Hildt Agreement” establishing policies and guidelines for operating those portions of the Pike Place Market (“Market”) owned by the PDA; and

WHEREAS, as authorized by Ordinance 119382, in 1999 the PDA and the City entered into the Hildt-Licata Agreement, a ten-year extension of the Hildt Agreement, as amended to provide guidelines for managing the Market daystalls, including using farm tables; and

WHEREAS, as authorized by Ordinance 122864, in 2008 the PDA and City entered into an Amended and Restated Hildt-Licata Agreement, a ten-year extension of the Hildt-Licata Agreement, without changes; and

WHEREAS, discussions and public meetings in 2018 between the PDA and the various Market constituencies resulted in unanimous agreement that the Hildt-Licata Agreement should be renewed, with minimal changes to reflect an updated list of grandfathered vendors and to identify the additional space that may be used for daystalls in the recently completed MarketFront Pavilion, for another ten-year term; the PDA Council agreed and by Resolution 18-45 requested the City Council to concur; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. To continue to preserve the historic qualities of the Pike Place Market, ensure its economic viability, promote good management and harmonious relations among Market users, and reflect the additional space that may be used for daystalls in the recently completed MarketFront Pavilion, the Mayor is authorized to execute an Amended and Restated Agreement Between The City of Seattle and the Pike Place Market Preservation and Development Authority, renewing and restating the substantive provisions with revisions to reflect the additional space associated with the MarketFront Pavilion for a term of ten years, and amending the Term of the Agreement and Notice provisions, substantially in the form attached to this ordinance as Exhibit A.

Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
