AN ORDINANCE relating to the City’s 2019 Budget; authorizing acceptance of funding from non-City sources; authorizing the heads of the Seattle Department of Transportation and Seattle Center to accept specified grants and to execute, deliver, and perform corresponding agreements for and on behalf of the City; amending Ordinance 125724, which adopted the 2019 Budget, including the 2019-2024 Capital Improvement Program (CIP); changing appropriations to the Seattle Department of Transportation in various budget control levels, and from various funds in the 2019 Budget; adding new projects to the 2019-2024 CIP; revising project allocations for certain projects in the 2019-2024 CIP; making cash transfers between the General Fund and the Transportation Fund; and ratifying and confirming certain prior acts; all by a 3/4 vote of the City Council.

WHEREAS, by Ordinance 125724, in November 2018, the Council adopted the City’s 2019 Budget, including the 2019-2024 Capital Improvement Program (CIP); and
WHEREAS, since adoption of the 2019 Budget, including the 2019-2024 CIP, additional funding from the Washington State Convention Center, Sound Transit, Oak View Group, and King County has been committed to advance various capital improvement projects related to transportation; and
WHEREAS, The City of Seattle receives formula funds from the Federal Transit Administration for preventive and major maintenance of the Seattle Streetcar system and the Monorail; and
WHEREAS, The City of Seattle was awarded funds from Federal Highway Administration grant programs for design and construction of sidewalks, crossing improvements, bicycle facilities, paving, signal improvements, transit improvements, and the Northgate Pedestrian and Bicycle Bridge; and
WHEREAS, The City of Seattle was awarded funds from the Transportation Improvement Board for the design and construction of an East Marginal Way bicycle facility; and
WHEREAS, Puget Sound Regional Council (PSRC) has solicited the Seattle Department of Transportation regarding the City’s readiness to accept and rapidly obligate contingent grant funding for the East Marginal Way Heavy Haul Project; and
WHEREAS, PSRC requires obligation of contingent grant funds by July 15th, 2019 but will not award funds until June 2019; and
WHEREAS, these grant funds require execution of agreements; and
WHEREAS, spending of these grants will begin in 2019; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. In order to pay for necessary costs and expenses incurred or to be incurred in 2019, but for which insufficient appropriations were made due to causes that could not reasonably have been foreseen at the time of the making of the 2019 Budget, appropriations for the following items in the 2019 Budget are increased from the funds shown, as follows:

Section 2. The Seattle Transportation Benefit District (STBD) Capital Improvements project (ID: MC-TR-C097), as described in Attachment A to this ordinance, and the North of Downtown Mobility Action Plan project (ID: MC-TR-C101), as described in Attachment B to this ordinance, are established in the 2019-2024 Adopted Capital Improvement Program.
Section 3. Appropriations in the 2019 Adopted Budget and project allocations in the 2019-2024 Adopted Capital Improvement Program are modified as follows:

These modifications shall operate for the purposes of decreasing or increasing the basis for the limit imposed by subsection 4(c) of Ordinance 125724.
Unspent funds so appropriated shall carry forward to subsequent fiscal years until they are exhausted or abandoned by ordinance.
Section 4. The Directors of the Seattle Department of Transportation and Seattle Center are authorized to accept the following non-City funding from the grantors listed below, and to execute, deliver, and perform agreements for the purposes described below. The funds, when received, shall be deposited in the receiving fund identified below to support, or as reimbursement for, the corresponding appropriations set forth in Section 5 of this ordinance.

* This allocation amount is after the transaction identified in item 6.1.
Section 7. The Director of the Seattle Department of Transportation is authorized to accept up to $4 million of non-City funding from the Puget Sound Regional Council for the East Marginal Way Heavy Haul Project, contingent upon receipt of final award from Puget Sound Regional Council. The funds, when received, shall be deposited in the Transportation Fund (13000).
Section 8. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.
Section 9. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
