AN ORDINANCE related to the City Light Department; authorizing the General Manager and Chief Executive Officer of City Light to execute a Reliability Coordinator Funding Agreement with Peak Reliability, Inc.

WHEREAS, Peak Reliability, Inc. (“Peak”) is registered and certified with the North American Electric Reliability Corporation as the Reliability Coordinator (“RC”) and Interchange Authority functions for all or parts of 14 western states, British Columbia, and the northern portion of Baja California, Mexico; and
WHEREAS, Peak is required by applicable law, including NERC Reliability Standards, to perform monitoring for registered balancing authorities (“BA”) and transmission operators (“TOP”) entities within the U.S. portion of the Western Interconnection; and
WHEREAS, Peak’s services include situational awareness and real-time monitoring and regional coordination of energy and transmission resources of the RC Area to certain electric utilities within the Western Interconnection, in order to minimize disruptions, provide leadership, and assure reliability of the bulk electric system; and
WHEREAS, as part of its ongoing federal reliability obligations, The City of Seattle, by and through its City Light Department (“City Light”), is registered and certified by NERC as a BA and a TOP, and must be an active member of Peak for RC services ; and
WHEREAS, prior to Peak’s existence, City Light paid for and received its RC services from Western Electric Coordinating Council (“WECC”), who previously performed RC functions within the Western Interconnection; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The General Manager and Chief Executive Officer of the City Light Department, or the General Manager and Chief Executive Officer’s designee, is hereby authorized to execute for and on behalf of The City of Seattle the Reliability Coordinator Funding Agreement, substantially in the form attached hereto as Attachment 1.
Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
