AN ORDINANCE relating to the City Light Department; declaring certain real property rights to be surplus to the City’s needs; and authorizing the General Manager and Chief Executive Officer of City Light to execute a property transfer agreement and related documents to transfer a City-owned parcel of land located in Snohomish County and purchased in 2011 with funds from a State of Washington Salmon Recovery Funding Board grant to the Town of Darrington for the purpose of creating a public park with recreational access to the Sauk River.

WHEREAS, in 2011 City Light purchased a parcel of land in the Town of Darrington, Snohomish County (Assessor Parcel #P 32092400200300) with funds from Salmon Recovery Funding Board (SRFB) Grant 10-1769 for the purposes of protecting habitat for salmon recovery; and

WHEREAS, the SRFB grant required City Light to record Deed of Right to the State of Washington with conditions under which the property is to be managed and protected in perpetuity for salmon habitat benefits; and

WHEREAS, the Town of Darrington does not currently have safe access along the Sauk River for public recreational use and enjoyment and has requested City Light to transfer fee ownership of Parcel #P 32092400200300 subject to the Deed of Right to the Town of Darrington in connection with a public grant application; and

WHEREAS, the Town of Darrington successfully obtained the grant and has requested City Light to proceed with the transfer of the property to the Town of Darrington in accordance with the Real Property Transfer Agreement substantially in the form in Attachment A to this ordinance to complete the requirements of the grant, and upon such transfer of the property through a Quitclaim Deed as shown in Attachment B to this ordinance will assume full responsibility for meeting the requirements of SRFB Grant 10-1769 and the Deed of Right; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. After a public hearing and pursuant to RCW 35.94.040, those real property rights described in the Real Property Transfer Agreement and Quitclaim Deed attached to this ordinance as Attachments A and B respectively, are declared to be no longer required for electric utility purposes and are surplus to the City’s needs.

Section 2. The General Manager and Chief Executive Officer of Seattle City Light, or designee, is authorized to execute the Real Property Transfer Agreement and Quit Claim Deed, and related documents for the transfer of ownership of the property to the Town of Darrington, for and on behalf of The City of Seattle.

Section 3. This ordinance shall take effect as provided by Seattle Municipal Code Sections 1.04.020 and 1.04.070.
