Recitals:

Seattle Public Utilities (SPU) is responsible within the City for public stormwater management, including but not limited to controlling surface water runoff on steep slopes and landslide prone areas, and prioritizing maintaining drainage within natural drainage courses.

SPU identified drainage conditions adjacent to 13709 41st Ave NE that may undermine property stability, cause erosion to public property, and decrease slope stability.

SPU determined the best course of action to resolve these drainage issues is to construct drainage improvements within the public right-of-way and on adjacent private property.

This work requires the City obtain easements on private property to allow SPU to install, operate, maintain, repair, and replace its infrastructure.

The property owner and SPU have agreed to terms and fair market value compensation for the easements.

The property owner of 13709 41st Ave NE has granted an easement to The City of Seattle to install and operate the needed drainage improvement infrastructure, and such easement requires approval by ordinance of the City Council. Therefore,

Be it ordained by The City of Seattle as follows:

Section 1. The General Manager and Chief Executive Officer of Seattle Public Utilities, or designee, is authorized to accept, for and on behalf of The City of Seattle, the following permanent easement for stormwater drainage purposes, described below and legally described in Attachment 1 to this ordinance.

Grantor: Jens Peter Steinhagen, recorded under King County Recording number 20250210000669.

Section 2. The real property rights and interests conveyed by the easement referenced and accepted in this ordinance shall be placed under the jurisdiction of Seattle Public Utilities.

Section 3. Any act consistent with the authority of this ordinance taken prior to its effective date is ratified and confirmed.

This ordinance shall take effect as provided by Seattle Municipal Code Sections 1.04.020 and 1.04.070.
