AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the Superintendent of Parks and Recreation to enter into an Agreement with the Washington State Department of Transportation (WSDOT) to accept and expend funds provided by WSDOT to implement the design and construction of certain recreational improvements as mitigation measures for the recreational impacts of the Portage Bay Bridge Roanoke Lid portion of the SR 520, I-5 to Medina: Bridge Replacement and HOV Project; amending Ordinance 126725, which adopted the 2023 Budget, changing appropriations to various departments and budget control levels, and from various funds in the Budget.

WHEREAS, the Washington State Department of Transportation (WSDOT) applied to the City for approval of a Shoreline Substantial Development Permit for the Portage Bay Bridge Roanoke Lid portion of the SR 520, I-5 to Medina: Bridge Replacement and HOV Project and on July 28, 2022, the Seattle Department of Construction and Inspections issued its Analysis and Decision, conditionally approving the Shoreline Substantial Development Permit; and
WHEREAS, one of the conditions of the Permit requires that WSDOT provide $700,000 to Seattle Parks and Recreation to support the design and construction of certain recreational improvements as mitigation measures for recreational impacts of the Portage Bay Bridge Project; and
WHEREAS, Seattle Parks and Recreation seeks authorization to accept and expend the funds from WSDOT to implement the design and construction of recreational improvements as mitigation measures for the recreational impacts of the Portage Bay Bridge Project that include some or all of the following: park improvements at the Everett Avenue East Shoreline Street End; a trail connection from Montlake Playfield to West Montlake Park; a shoreline nature trail from the Mountlake Playfield boat launch to the Bill Dawson Trail; widening and hardening of the 15th Avenue East trail and nearby meadow loop trail; improvement of the Montlake Playfield kayak launch; and an improved link between the Portage Bay shoreline and upland areas and nearby neighborhoods; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation (“Superintendent”), or the Superintendent’s designee, is authorized to execute for and on behalf of the City an Agreement with the Washington State Department of Transportation to accept and expend funds from the Washington State Department of Transportation (WSDOT) to implement the design and construction of recreational improvements as mitigation measures for the recreational impacts of the Portage Bay Bridge Project that include some or all of the following: park improvements at the Everett Avenue East Shoreline Street End; a trail connection from Montlake Playfield to West Montlake Park; a shoreline nature trail from the Mountlake Playfield boat launch to the Bill Dawson Trail; widening and hardening of the 15th Avenue East trail and nearby meadow loop trail; improvement of the Montlake Playfield kayak launch, and an improved link between the Portage Bay shoreline and upland areas and nearby neighborhoods. The Agreement shall be substantially in the form of the GCB 3780 Agreement for Funding of Recreational Improvements as Mitigation for the SR520 Portage Bay Bridge Roanoke Lid Project Between Washington State Department of Transportation and City of Seattle Parks and Recreation, which is attached to this ordinance as Attachment 1 (the “WSDOT Agreement”).
Section 2. Contingent upon the execution of the Agreement and receipt of the funds authorized under Section 1, the appropriations for the following items in the 2023 Budget are increased as follows:

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
