AN ORDINANCE related to appropriations for the Office of Arts & Culture; amending Ordinance 125207, which adopted the 2017 Budget; and lifting a proviso imposed on the Office of Arts & Culture’s Capital Arts Budget Control Level by Seattle City Council Green Sheet 68-1-B-1.

WHEREAS, the 2017 Adopted City of Seattle Budget included $1,300,000 of capital funding for four nonprofit cultural institutions; and
WHEREAS, this funding was intended to support the construction and renovation of cultural facilities at the Nordic Heritage Museum, the Burke Museum, the Richard Hugo House, and Town Hall; and
WHEREAS, the City Council (“Council”) adopted a proviso on this funding that no funding could be spent until authorized by future ordinance; and
WHEREAS, Council anticipated that authority would not be granted until the Executive had negotiated and approved the proposed Public Benefit packages related to each project; and
WHEREAS, the Office of Arts & Culture has negotiated and approved Public Benefit agreements with all four institutions to the Executive’s satisfaction; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The restrictions imposed by the following budget proviso, which limit spending on the following items, are removed because the conditions set forth in the proviso have been satisfied and they are no longer restrictions for any purpose, including those set forth in Attachment A as referenced in Section 1, Subsection (b) to Ordinance 125207:

"None of the money appropriated in the 2017 budget for the Office of Arts and Culture’s Capital Arts BCL may be spent for the Nordic Heritage Museum, the Burke Museum, Town Hall, or the Hugo House projects until authorized by future ordinance. Council anticipates that such authority will not be granted until the Executive provides Council with negotiated contracts detailing the public benefits that will be delivered by each partner agency in exchange for the City funding." |

Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
