A RESOLUTION relating to the Seattle Park District; establishing the Community Oversight Committee and setting its membership and terms of office; and ratifying and confirming certain prior acts.

WHEREAS, Ordinance 124467 authorized the submission to the voters of Seattle a proposition authorizing the formation of the Seattle Park District; and

WHEREAS, the Seattle Park District was approved by the voters on August 5, 2014; and

WHEREAS, Ordinance 124468, relating to an interlocal agreement with the Seattle Park District, directed the establishment of a Community Oversight Committee to provide advice to the Mayor, City Council, and Superintendent of Parks and Recreation and provide oversight of projects, programs and services undertaken by the Seattle Parks District; and

WHEREAS, legislation is needed to formally authorize the establishment of this Committee and to set its membership and terms of office; NOW, THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE, THE MAYOR CONCURRING, THAT:

Section 1.

A. The Community Oversight Committee for the Seattle Park District (Committee) is established.  The Committee consists of 15 positions numbered 1 to 15. Positions 1 through 8 shall be appointed by the Mayor subject to confirmation by a majority vote of the City Council. Positions 1 through 4 shall be filled by members of the Board of Park Commissioners (Board). Positions 5 through 8 shall be filled by members considered for appointment based on recommendations from City commissions, including the Immigrant and Refugee Commission, the Commission for People with Disabilities, the Human Rights Commission, the Seattle Lesbian Gay Bisexual Transgender Commission, and the Women’s Commission. A member from each Council district shall be appointed by a majority vote of the City Council into positions 9 through 15, which correspond in ascending numerical order to Council Districts 1 through 7.

B. The Community Oversight Committee terms for positions 1 through 4 shall coincide with the members’ Board terms. The initial term for positions 6, 8, and 12 shall expire on March 31, 2018; the initial term for positions 10, 11, 14, and 15 shall expire on March 31, 2019; and the initial term for positions 5, 7, 9, and 13 shall expire on March 31, 2020. Subsequent terms for positions 5 through 15 shall begin on April 1 and be for three years.

C. Any vacancy in an unexpired term shall be filled in the same manner as the original appointment. A member whose term is ending may continue on an interim basis as a member with voting rights until such time as a successor for that position has been appointed by the City Council or confirmed by the City Council.

D. The Mayor shall appoint the initial Chair of the Community Oversight Committee. Thereafter, the Committee shall appoint the Chair on an annual basis.

Section 2.  The Community Oversight Committee shall advise on spending and activities including:

A. Establishing a Major Projects Challenge Funds application process and evaluation criteria, and make recommendations to the Superintendent of Parks and Recreation (Superintendent) on the annual allocation of the Major Projects Challenge Fund.

B. Reviewing an annual report prepared by the Department of Parks and Recreation (DPR) for the Seattle Park District and the City, including assessment of performance measures and expenditure of District funds including interest earnings, and reporting to the Superintendent and Board on implementation issues, concerns and needed adjustments in services or spending.

C. Holding public meetings and making recommendations to the Superintendent in connection with each six-year update to the spending plan.

D. Providing to the Mayor, City Council, and Superintendent an annual report on the progress of expenditures, a mid-term report halfway through each six-year period, and a final report in advance of each six-year update to the spending plan. Progress on construction of park development on the 14 land-banked sites funded in the first six-year financial plan will be among the issues addressed in the first mid-term report.

Section 3. Any act consistent with the authority of this resolution taken prior to its adoption is ratified and confirmed.
