AN ORDINANCE amending the Amended Landscape Conservation and Infrastructure Program Funding Plan for the South Lake Union and Downtown as adopted by Ordinance 127252; amending Ordinance 127156, which adopted the 2025 Budget, including the 2025-2030 Capital Improvement Program; changing appropriations to various departments and budget control levels, and from various funds in the Budget; making an appropriation from the Park and Recreation Fund for related costs; and ratifying and confirming certain prior acts; all by a 3/4 vote of the City Council.

WHEREAS, the Seattle Parks Foundation, a non-profit organization, was created in 1999 to provide funds, project support, and advocacy to improve and expand Seattle’s parks and greenspaces; and
WHEREAS, the City's 2025-2030 Adopted Capital Improvement Program (CIP) includes $1.4 million in 2025 and $2.3 million in 2026 of Real Estate Excise Tax proceeds to support revitalization of Westlake Plaza; and
WHEREAS, the CIP lists possible uses for this funding, including removal of certain park features, including an out-of-commission fountain in the form of a waterwall, stage and accompanying arch, electrical system upgrades, and repairs to paving and trip hazards, among other investments; and
WHEREAS, the City Council on November 21, 2024, adopted the CIP in Ordinance 127156; and
WHEREAS, the City entered into a settlement agreement in November 2025 to address concerns raised by the artist who originally designed the Seven Hills artwork at Westlake Park in which the City committed to expand the scope of the project to include the removal, storage, and eventual relocation of the Seven Hills sculptures and certain elements of the waterwall and arch; and
WHEREAS, Seattle Parks and Recreation received revenues through the Landscape Conservation and Local Infrastructure Program (LCLIP) in excess of planned 2025 revenues; and
WHEREAS, Westlake Park is within the LCLIP Project area; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Amended Landscape Conservation and Local Infrastructure Program Infrastructure Funding Plan for South Lake Union and Downtown is adopted as shown in Attachment A to this ordinance.
Section 2. In order to pay for necessary costs and expenses, but for which insufficient appropriations were made due to causes that could not reasonably have been foreseen at the time of the making of the 2025 Budget, appropriations for the following items in the 2025 Budget are increased from the funds shown, as follows:

Section 3. Any act consistent with the authority of this ordinance taken prior to its effective date is ratified and confirmed.
Section 4. This ordinance shall take effect as provided by Seattle Municipal Code Sections 1.04.020 and 1.04.070.
