AN ORDINANCE relating to Seattle Public Utilities; authorizing the General Manager and Chief Executive Officer of Seattle Public Utilities to apply for funding assistance from the Washington State Recreation Conservation Office Funding Board, to accept specified grants, and to execute, deliver, and perform corresponding agreements.

WHEREAS, on August 7, 1989, the Seattle City Council approved Ordinance 114632, adopting the Cedar River Watershed Secondary Use Policies, and these policies include direction to improve recreation areas and trails in and around Rattlesnake Lake; and
WHEREAS, Seattle Public Utilities constructed and owns and manages the Rattlesnake Ledge Trail for public enjoyment, and the trail is one of the most popular in King County, and is currently in need of major maintenance to support the high level of use and to protect public safety; and
WHEREAS, the state of Washington’s Non-Highway and Off-Road Vehicle Activities Program provides funding assistance to create opportunities for such activities as cross-country skiing, hiking, horseback riding, mountain bicycling, hunting, fishing, sightseeing, motorcycling, and riding all-terrain vehicles; and
WHEREAS, Seattle Public Utilities intends to apply for funding under the program for improvements as part of the utility’s Rattlesnake Ledge Trail improvement project; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The General Manager and Chief Executive Officer of Seattle Public Utilities is authorized to apply to the Recreation Conservation Funding Board for grant assistance in the amount set forth in the “Grant Request” of $150,000 to support the maintenance and improvement of the Rattlesnake Ledge Trail; to accept specified grants; and to execute, deliver, and perform corresponding agreements.
Section 2. Any grant assistance received will be used only for direct, eligible, and allowable costs that are reasonable and necessary to implement the project referenced in Section 1 of this ordinance.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
