AN ORDINANCE related to the Municipal Arts Fund; amending Section 20.32.050 of the Seattle Municipal Code to allow for expenditures related to public art maintenance; and ratifying and confirming certain prior acts.

WHEREAS, the Office of Arts and Culture (“Arts”) is the administrator of the Municipal Arts Fund (MAF), which primarily supports public art investment in The City of Seattle (“City”) via the One Percent for Art program; and
WHEREAS, Section 20.32.050 of the Seattle Municipal Code places limitations on the MAF’s support for conservation and maintenance of public art investments regardless of the funding source; and
WHEREAS, this limitation affects the City’s ability to account for revenue and spending related to this function within the Arts MAF financial plan; and
WHEREAS, Arts, in prior years, has spent directly from the Cumulative Reserve Subfund - Unrestricted (CRS-U) Budget Control Level to provide maintenance; and
WHEREAS, direct spending from a funding source BCL is not the preferred method for spending, as it tracks workload outside of the assigned department’s financials; and
WHEREAS, the 2016 Adopted Budget provided an appropriation in Arts from the MAF, assumed a contribution of CRS-U revenue to the MAF, and created a new program to track maintenance of public arts investments in Arts for transparency purposes; and
WHEREAS, a technical change to the Seattle Municipal Code concerning the MAF is necessary to be consistent with the 2016 Adopted Budget; and
WHEREAS, this action does not change appropriation or funding to Arts in 2016 or future years: it changes the way expenditures and revenues are tracked for accounting and budget purposes; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Section 20.32.050 of the Seattle Municipal Code, last amended by Ordinance 124539, is amended as follows:
20.32.050 - Municipal Arts Fund
There is established in the City Treasury a special fund designated “Municipal Arts Fund” into which shall be deposited funds appropriated as contemplated by Section 20.32.030, together with such other funds as the City Council shall appropriate for works of art. ((, and from which expenditures)) Expenditures may be made from this fund for the acquisition and exhibition of works of art consistent with the plan specified in subsection 20.32.040.A, and for Office of Arts and Culture staff costs and administrative costs (as defined in ((subsection 20.32.020.F)) Section 20.32.020) that are associated with developing and implementing the Municipal Arts Plan ((, but not)) including the cost of maintaining City-owned ((art work)) artwork, which maintenance cost may be paid from the Cumulative Reserve Subfund or such other eligible source(s) as may be specified by ordinance. Separate accounts shall be established within the Municipal Arts Fund to segregate receipts by source or, when so directed by the City Council, for specific works of art. Disbursements from such fund shall be made in connection with projects approved by the Seattle Arts Commission on vouchers approved by the Director of the Office of Arts and Culture.
Section 2. Ratify and Confirm. Any act consistent with the authority of this ordinance taken prior to its effective date is ratified and confirmed.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
