AN ORDINANCE relating to Seattle Parks and Recreation; authorizing the execution of the required harbor leases with the Washington State Department of Natural Resources for the North and South Leschi Moorages and the Leschi South Public Moorage; and ratifying and confirming certain prior acts.

WHEREAS, Seattle Parks and Recreation (“SPR”) entered into inner harbor aquatic lands leases (“Leases”) with the Washington State Department of Natural Resources (“DNR”) for the right to use DNR’s inner harbor lines for SPR’s public North (DNR No. 22-090021) and South (DNR No. 22-A02758) Leschi Moorages on May 19, 1994, under the authority of Ordinance 116785; and
WHEREAS, said Leases’ terms expired November 30, 2022, and converted to DNR-approved holdover status; and
WHEREAS, SPR desires to continue providing moorage opportunities to park users at the North and South Leschi moorages by renewing said Leases; and
WHEREAS, SPR entered into a Marina Lease Agreement with Marina Management, LLC (“Marina Lease”), to control, operate, and manage the Leschi Moorages, and to coordinate with the City to implement certain tenant and City capital improvements; and
WHEREAS, the Marina Lease is conditioned upon the City and DNR entering into extensions of the existing DNR leases; and
WHEREAS, SPR is currently designing the Leschi South Marina Wave Attenuator and Facility Improvements, which will replace existing creosote treated piles and inadequate wave attenuators with a new dock and wave attenuators, sewage pump-out, electric and water services to a new public transient moorage facility at the South Leschi Marina; and
WHEREAS, portions of the pending improvements will cross the inner harbor line into DNR’s outer harbor; and
WHEREAS, DNR requires a new, separate aquatic lands lease for use of the outer harbor (DNR No. 22-100320); NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Seattle Parks and Recreation or the Superintendent’s designee is authorized to enter into and execute three Aquatic Lands Leases, No. 22-090021, No. 22-A02758, and No. 22-100320, with the Washington State Department of Natural Resources (“DNR”), substantially in the form of the leases attached to this ordinance as Exhibits A, B, and C, respectively.
Section 2. Any act consistent with the authority of this ordinance taken prior to its effective date is ratified and confirmed.
Section 3. This ordinance shall take effect as provided by Seattle Municipal Code Sections 1.04.020 and 1.04.070.
