An ordinance relating to Seattle Public Utilities; authorizing the acquisition by negotiation or eminent domain (condemnation) of three parcels of land in Seattle for utility purposes identified as King County Parcel Numbers 302604-9100 (11762 Aurora Ave N), 302604-9116 (12004 Aurora Ave N), and 302604-9124 (12020 Aurora Ave N), authorizing the General Manager and Chief Executive Officer of Seattle Public Utilities (General Manager/CEO) or their designee to execute all documents and take other actions deemed by the General Manager/CEO or designee as necessary to complete the acquisitions; placing the real properties conveyed to the City under the jurisdiction of Seattle Public Utilities; and ratifying and confirming certain prior acts.

Recitals:
Seattle Public Utilities (SPU) requires additional operational space to support present and future North Seattle utility system needs for maintenance, material storage, emergency response, and Water - Drainage operational coordination.
The proposed North One Water Facility is intended to serve as the primary base for SPU’s Water Line of Business and Drainage and Wastewater Line of Business and will provide emergency back up to the critical command and control functions at SPU’s Operations Control Center in SODO.
Acquisition of the property will enhance SPU’s ability to efficiently operate across its geographical service area, improving system reliability, maintenance, customer support, and emergency response times.
The property has been evaluated and determined to be suitable for utility purposes, subject to completion of due diligence including environmental review, title review, and other standard acquisition requirements.
Puetz Associates Limited Liability Partnership owns three parcels identified by Seattle Public Utilities for acquisition that are located at 1762 Aurora Ave N, 12004 Aurora Ave N, and 12020 Aurora Ave N, all within Seattle, and desires to sell those properties.
Funds are available within SPU’s adopted Capital Improvement Program and/or budget to complete the acquisition.
The North One Water Operations Complex project is included as a priority in SPU’s 2024 Workforce Facilities Master Plan Update.
RCW 8.12.030, 35.67.020, and 35.92.020 authorize The City of Seattle to purchase or condemn property for utility or general municipal purposes. Therefore,
Be it ordained by The City of Seattle as follows:
Section 1. Public convenience and necessity require the property identified in the records of the King County Assessor as Parcel Numbers 302604-9100, 302604-9116, and 302604-9124 situated in the City of Seattle, County of King, State of Washington, together with all rights, privileges, and other related real property interests, legally described and depicted in Attachment 1 of this ordinance to be acquired through negotiation or eminent domain (condemnation) for public utility purposes.
Section 2. The General Manager and Chief Executive Officer of Seattle Public Utilities (General Manager/CEO) or their designee is authorized on behalf of The City to negotiate and to enter into agreements to acquire the real property described in Section 1 of this ordinance, to execute all documents and take other actions deemed by the General Manager/CEO or his designee as necessary to complete the acquisitions, and to accept and record deeds and other necessary instruments on behalf of the City.
Section 3. The Seattle City Attorney is authorized to commence and prosecute proceedings in the manner provided by law to condemn, take, damage, and appropriate in fee simple the real property or other property rights described in Section 1 of this ordinance, after just compensation has been made or paid into court for the owners thereof in the manner provided by law. The Seattle City Attorney is further authorized to enter into a stipulation agreement for purposes of minimizing damages.
Section 4. The real property, when acquired by the City, shall be placed under the jurisdiction of Seattle Public Utilities and designated for utility purposes.
Section 5. The acquisition and associated costs, including but not limited to the purchase price, closing costs, and due diligence expenses, shall be paid from funds appropriated to Seattle Public Utilities in the adopted budget and/or Capital Improvement Program.
Section 6. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.
