AN ORDINANCE relating to the City Light Department; authorizing the General Manager and Chief Executive Officer to enter into a lease agreement with the Washington State Department of Natural Resources for use of the Gold Mountain communications facility in Kitsap County, Washington; and ratifying and confirming certain prior acts.

WHEREAS, the Washington State Department of Natural Resources maintains a communications facility, consisting of an equipment building and antenna farm, on Gold Mountain in Kitsap County, Washington; and
WHEREAS, Seattle City Light has leased space at the Gold Mountain communications facility for radio repeater equipment, as authorized by Ordinance 115471, since 1990; and
WHEREAS, the radio repeater equipment at the Gold Mountain facility is essential for maintaining radio communications between power generation operations at the Skagit Hydroelectric Project and the Power Control Center in Seattle, and with City Light field crews; and
WHEREAS, the City's original lease has expired, and the Washington State Department of Natural Resources has offered the City a new lease to continue use of the Gold Mountain facility through December 31, 2019; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The General Manager and Chief Executive Officer of Seattle City Light, or the General Manager and Chief Executive Officer's designee, is authorized to execute a Communications Site Facility Lease on behalf of The City of Seattle, substantially in the form of Attachment 1 hereto, with the Washington State Department of Natural Resources (DNR), for the use of the DNR communications facility on Gold Mountain in Kitsap County, Washington.
Section 2. Any act consistent with the authority of this ordinance taken after its passage and prior to its effective date is ratified and confirmed.
