AN ORDINANCE granting SDC Creative LLC permission to maintain and operate a skybridge over and across South Orcas Street, east of 5th Avenue South, for a ten-year term, renewable for two successive ten-year terms; specifying the conditions under which this permit is granted; providing for the acceptance of the permit and conditions; and ratifying and confirming certain prior acts.

WHEREAS, by Ordinance 110682, the City of Seattle ("City") granted permission to the Benaroya Company to construct, maintain, and operate a skybridge over and across South Orcas Street, east of 5th Avenue South; and
WHEREAS, ownership of the skybridge was transferred from the Benaroya Company to Pacific Northwest Group B and subsequently transferred to Hines REIT Seattle Design Center LLC, and
WHEREAS, the permission authorized by Ordinance 110682 was amended by Ordinance 121855 and Resolution 28645 to allow its extension for a maximum of 30 years, and the permission ended on August 25, 2012; and
WHEREAS, Hines REIT Seattle Design Center LLC has applied to the Director of Transportation to continue maintaining and operating the skybridge and has satisfied all the terms of the original authorizing ordinance as amended; and
WHEREAS, SDC Creative LLC purchased the property located at 5601 6th Avenue South and 5701 6th Avenue South on December 2, 2014, and SDC Creative LLC has accepted the terms and conditions of Ordinance 110682, as amended by Ordinance 121855 and Resolution 28645, and applied to transfer the application to renew the skybridge from Hines REIT Seattle Design Center LLC to SDC Creative LLC; and
WHEREAS, the Seattle Design Commission recommended approval of the existing skybridge and public benefit mitigate elements, including: replacing trees on South Orcas Street, installing wayfinding and neighborhood signage, installing a bike rack, making landscape improvements along So...
