AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the Superintendent of Parks and Recreation to sign a lease with Sprint Communications Company L.P. for continuing use of subsurface fiber-optic cable installed in the Burke-Gilman Trail.

WHEREAS, Ordinance 114004 adopted in June 1988 authorized an Agreement with Sprint Communications Company (Sprint) for a non-exclusive permit to construct underground conduits and install fiber-optic cables in portions of the Burke-Gilman Trail; and
WHEREAS, Sprint has occupied the Burke-Gilman Trail pursuant to that 1988 agreement which expired in July 2013; and
WHEREAS, the terms of that agreement included cash payments and construction of extensive improvements to the Burke-Gilman Trail which now exist and are being enjoyed by the public; and
WHEREAS, Sprint desires to continue its subsurface use of Burke-Gilman Trail property to provide data and voice transmission services to its customers; and
WHEREAS, Sprint's continued use of the Burke-Gilman Trail will not affect its recreational use by the public and will provide a long term source of revenue to the City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation or the Superintendent's designee is hereby authorized, on behalf of The City of Seattle, to execute a Lease agreement, Attachment A hereto, with Sprint Communications Company L.P., a limited partnership organized under the laws of the State of Delaware.


Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
