WHEREAS, the City in 1958 approved Ordinance 87325 accepting a deed by Clinton C. Berg and Lillian M. Berg, his wife, and Kalmer H. Berg and Nayome Berg, his wife, for a water main pipeline right-of-way; and
WHEREAS, in 1962 a 54-inch diameter water supply line was built that crossed through this property; and
WHEREAS, at an unknown time King County, mistakenly and without notification to the City of Seattle, took acquisition of this property for non-payment of property taxes; and
WHEREAS, the water supply line is in active use; and
WHEREAS, King County agreed to provide a quit claim deed for the property to the City of Seattle; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The City of Seattle accepts a Quit Claim Deed, King County Recording No. 20131203000277, from King County for the following described property for utility purposes:
That portion of Lot 1, Loma Vista, according to the plat thereof recorded in Volume 56 of Plats, Page 17, in King County, Washington described as follows:
Beginning at the southwest corner of said Lot 1;
Thence east along the south line thereof a distance of 25.42 feet;
Thence North 39-44-52 west a distance of 36.44 feet to a point in the west line of said Lot 1;
Thence south along said west line a distance of 27.11 feet to the Point of Beginning.
Section 2. The Property thus acquired shall be placed under the jurisdiction of Seattle Public Utilities.
