AN ORDINANCE relating to the City Light Department; granting authority to accept and execute revenue and funding source agreements to support the operation and services of the Lighting Design Lab; and ratifying and confirming certain prior acts.

WHEREAS, the Lighting Design Lab (LDL) is a Pacific Northwest regional (Washington, Oregon, Idaho and Montana) education and technology center for the advancement, training, promotion, and support of quality energy-efficient lighting and related energy efficient building technologies and practices; and
WHEREAS, in 1988, the LDL was originally established by The City of Seattle under Ordinance 114187 and has since been owned, operated, and funded by the City Light Department, with collaboration and limited financial sponsorship from many public and private electrical utilities and interested groups, from 1989 to present day; and
WHEREAS, the LDL operationally provides independent evaluation and verification of commercial lighting and associated integrated energy efficiency product performance, and shares this information with regional utilities as they build their conservation incentive program portfolios to maximize energy savings per conservation dollar spent; and
WHEREAS, the LDL also provides classes and workshops for industry professionals related to utility energy efficiency programs and effective energy efficient design and retrofit techniques; provides consultations, technical information, demonstrations, education, and other support services and makes recommendations around technology systems and building integration strategies; serves as a resource for utility rebate programs; hosts technology fairs; and demonstrates lighting and integrated building technology products; and
WHEREAS, over the next 20 years, lighting and related integrated technologies will represent more than 50 percent of the energy savings potential in the Northwest commercial and industrial buildings sector; and
WHEREAS, although the City Light Department has provided the majority of LDL's funding from the Light Fund funding source since 2008, the LDL has historically relied upon revenue sources from limited sponsorships, grants, or donations from LDL sponsors and energy partners and funders, such as the U.S. Department of Energy; and
WHEREAS, the LDL's sponsors now broadly include the City Light Department; U.S. Department of Energy; Northwest Energy Efficiency Alliance; Puget Sound Energy; Energy Trust of Oregon; Bonneville Power Administration; Snohomish County Public Utility District; Tacoma Power; Idaho Power; British Columbia Hydro; the State of Alaska; Portland General Electric; University of Washington; and Washington State University, who have all expressed interest or willingness to donate or financially support the LDL under formal revenue and funding source agreements; and
WHEREAS, The City of Seattle desires to continue to be a leader in energy efficiency and to support the Pacific Northwest region by supporting the LDL's continued operations and modernization while relieving some of the burden of operations funding by the City Light Department by now authorizing the acceptance of funding and revenue sources to the LDL from sponsors, partners and various third party funders, by and through the authority to execute formal funding source agreements and other legal instruments; NOW, THEREFORE;
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The City Light Department's General Manager and Chief Executive Officer, or his designee, is authorized to accept, execute, modify, implement, and administer intergovernmental and third party revenue and funding source agreements, which shall include without limitation, grants, sponsorships, cooperating agreements, financial assistance instruments, and service contracts, in order to facilitate, promote, and support the Lighting Design Lab's (LDL) ongoing utility partnerships, technology projects and initiatives, and leadership services in energy efficiency; provided that such revenue and funding agreements relate to and advance the mission, operations, and services of the LDL, do not exceed the limitations or authority set forth within the annual operating budget of the City Light Department, and otherwise comply with applicable laws and City ordinances.
Section 2. Any act pursuant to the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.
 
 
Section 3.  This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
