A RESOLUTION relating to the Seattle Department of Parks and Recreation; authorizing applications for grant funding assistance to the Washington State Recreation and Conservation Office for Youth Athletics Facilities projects as provided in WAC 286 and subsequent legislative action.

WHEREAS, on November 28, 2011, the Seattle City Council passed Resolution 31336 adopting the Seattle Parks and Recreation 2011 Development Plan; and
WHEREAS, under the provisions of the Youth Athletic Facilities program (YAF), state grant assistance is available to aid in financing the cost of facility development, provided the grant recipient meets certain Washington State Recreation and Conservation Office (RCO) grant terms and conditions as provided in WAC 286 and subsequent legislative action, including an equivalent grant match for project funding; and
WHEREAS, the West Seattle Stadium Track and Field Renovations project (Project) is included in the Department of Parks and Recreation’s 2016-2021 Capital Improvement Program; and
WHEREAS, The City of Seattle, by and through the Seattle Department of Parks and Recreation (City), intends on applying for and accepting RCO Grant funding assistance for the West Seattle Stadium Track and Field Renovations project; and
WHEREAS, any RCO grant assistance received will be used for direct costs associated with implementation of the projects referenced above; and
WHEREAS, the City expects that the matching share of project funding will be derived from the Seattle Park District Major Maintenance Fund (Fix It First Initiative), and that pursuant to WAC 286-13-040(1)(c) the City must certify the available match at least one month before funding approval. In addition, the City understands it is responsible for supporting all non-cash commitments to this Project should RCO grant funding not materialize; and
WHEREAS, the City acknowledges that the RCO grant assistance, if approved, will be paid on a reimbursement basis, meaning the City will only request payment from the RCO after eligible and allowable costs have been incurred and payment remitted to vendors, and that RCO will hold retainage until the Project is deemed complete; and
WHEREAS, the City acknowledges that any facility developed through RCO grant assistance from the Recreation and Conservation Funding Board must be reasonably maintained and made available to the general public at reasonable hours and times of the year according to the type of area or facility unless other restrictions have been agreed to by the RCO Director or the Recreation and Conservation Funding Board; and
WHEREAS, the City acknowledges that any facility developed with RCO grant assistance from the Recreation and Conservation Funding Board must be dedicated for public outdoor recreation purposes, and be retained and maintained for at least 20 years from the date of final project reimbursement unless otherwise provided and agreed to by the Recreation and Conservation Funding Board; and
WHEREAS, this Resolution is a requirement to be eligible for RCO funding and becomes part of a formal application to RCO for grant assistance; and
WHEREAS, the City provided appropriate opportunity for public comment on this application; and
WHEREAS, the City considers it in the best public interest to complete the projects described in the applications; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE, THE MAYOR CONCURRING, THAT:
Section 1. The Superintendent of the Department of Parks and Recreation (Superintendent), or the Superintendent’s designee, is hereby authorized to submit applications for and on behalf of The City of Seattle (City), in such counterparts as are necessary, to the Washington Recreation and Conservation Office (RCO), for financial assistance in the amount set forth in the “Grant Request” column below:

Section 2. The Superintendent, or the Superintendent’s designee, is hereby authorized to accept the RCO grants funds in the amount of $250,000, including equivalent grant funding matching requirements and terms and conditions as set forth in WAC 286 and subsequent legislative action for the purposes of utilizing these funds for the City’s Project. The City’s required equivalent dollar for dollar matching funds for the Project shall be appropriated from the Seattle Park District Major Maintenance Fund (Fix It First Initiative).
Section 3. The Superintendent, or the Superintendent’s designee, is further authorized to act as the representative of the City to provide such information and documents as may be required by the RCO in connection to the application or acceptance of RCO grant funds for the Project.
