AN ORDINANCE relating to the West Seattle Junction Parking and Business Improvement Area; modifying the assessment rates; and amending Ordinance 113326, as previously amended by Ordinances 119539, 120570, and 121758, in accordance therewith.

WHEREAS, in 1987, through Ordinance 113326, the City established the West Seattle Junction Parking and Business Improvement Area (PBIA), providing for the levy of special assessments upon businesses within the PBIA for the purpose of enhancing conditions for operation of those businesses; and

WHEREAS, in 1999, through Ordinance 119539, the City increased the original assessment rates for the PBIA; and

WHEREAS, in 2001, through Ordinance 120570, the City clarified the legislation to more accurately describe and implement the intent of the petitioners who requested that the City create the PBIA; and

WHEREAS, in 2005, the City passed Ordinance 121758, increasing the established assessment rates for the PBIA, and there has been no subsequent increase in the assessment rates; and

WHEREAS, on May 25, 2016, the PBIA held a public ratepayer meeting to discuss increased expenses, highlighted a proposal to address the budget situation, and received feedback from its ratepayers; and

WHEREAS, on June 10, 2016, the ratepayer advisory board for the West Seattle Junction Association, which oversees the PBIA, voted to increase all assessment rates by ten percent for the purpose of preventing reduction in services due to inflation in prices; and

WHEREAS, on September 7, 2016, in accordance with RCW 35.87A.140, the City Council will hold a public hearing regarding its intention to raise the West Seattle PBIA’s assessment rates; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Section 2 of Ordinance 113326, previously amended by Ordinances 119539, 120570, and 121758, is further amended as follows:

Section 2. Levy of Special Assessments. To finance the activities outlined in Section 7, there is levied and shall be collected a special assessment upon the businesses in the area, determined as follows:

1)                     The City will levy special assessments for the purpose of operating a Parking and Business Improvement Area Program by applying the following rates against “the gross proceeds of the sales” or the “gross income of the business” as reported for City Business and Occupation or Utility Tax purposes, unless otherwise specified:

(a)                     In Zone A, retail businesses will pay (($2.75)) $3.025 per $1,000 gross income of the business annually and non-retail businesses will pay (($1.375)) $1.513 per $1,000, to a maximum of $3,740 $4,114 annually.

(b)                     In Zone B, retail businesses will pay (($1.375)) $1.513 per $1,000 gross income of the business annually and non-retail businesses will pay (($.737)) $0.811 per $1,000, to a maximum of (($3,740)) $4,114 annually.

(c)                     Banks, savings and loan, or other financial lending institutions shall pay a flat rate of (($3,740)) $4,114 annually.

(d)                     Auto Dealers shall pay a flat rate of (($1,870)) $2,057 annually and gas stations shall pay a flat rate of (($935)) $1,029 annually.

(e)                     Non-street-level non-retail businesses will pay the appropriate zone rate to a maximum fee of (($192.50)) $211.75 per year.

(f)                     Each business located in Zone C will pay a parking assessment of (($105)) $115.50 per parking space per year for street-level businesses, and (($52.50)) $57.75 per parking space per year for non-retail non-street-level businesses, for each parking space required under ((Chart)) Table A of SMC Section 23.54.015 that is not already provided by such business, and without regard to any reduction in the number of required parking spaces that may be authorized elsewhere in the Seattle Municipal Code or by any other law.

 

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
