AN ORDINANCE relating to the Seattle Transportation Benefit District; authorizing material scope changes to Seattle Transportation Benefit District Proposition 1; authorizing the Director of the Seattle Department of Transportation to execute an interlocal agreement with Seattle Public Schools to provide transit passes to Seattle Public Schools students; changing appropriations to the Seattle Department of Transportation to fund the ORCA Opportunity Program; and amending Ordinance 125493, which amended the 2018 Budget (Ordinance 125475); all by a 3/4 vote of the City Council.

WHEREAS, City of Seattle Ordinance 123397 established the Seattle Transportation Benefit District (STBD) for preserving and maintaining transportation infrastructure; improving public safety; implementing elements of the Seattle Transportation Strategic Plan and other planning documents; investing in bicycle, pedestrian, freight mobility, and transit enhancements; and providing people with choices to meet their mobility needs; and
WHEREAS, Revised Code of Washington (RCW) 36.73.160 requires the STBD to adopt a policy to address material changes to a project’s cost, scope, and schedule; and
WHEREAS, in STBD Resolution 3, the Governing Board of the STBD approved a material change policy that addresses the procedures for approving changes to project cost, scope, and schedule; and
WHEREAS, in STBD Resolution 12, the Governing Board of the STBD submitted a ballot measure (“STBD Proposition 1”) to the qualified electors of the STBD to authorize up to a 0.1 percent sales and use tax, and an annual vehicle license fee of up to an additional $60 per registered vehicle with a $20 rebate for low-income individuals, for the purposes of funding King County Metro Transit service in Seattle; and
WHEREAS, on November 4, 2014, STBD Proposition 1 was approved by a majority of qualified electors of the STBD; and
WHEREAS, on December 1, 2014, in STBD Resolution 14, the Governing Board of the STBD imposed the revenue measures authorized by the voters through the approval of STBD Proposition 1; and
WHEREAS, by Ordinance 125070, The City of Seattle assumed the rights, powers, immunities, functions, and obligations of the STBD as authorized under RCW 36.74.030; and
WHEREAS, The City of Seattle wants to improve access to the transit system, expand the capacity of the transit system, and improve speed and reliability of transit service to meet its growing population; and
WHEREAS, on February 20, 2018, Mayor Durkan announced the launch of the ORCA Opportunity Program to provide free transit access to all public high school students and Seattle Promise scholars at the start of the 2018-2019 school year; and
WHEREAS, pursuant to Section 8 of STBD Resolution 12, the Transit Advisory Board reviewed the proposed change of scope at their April 25, 2018, meeting; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Seattle Department of Transportation (SDOT) Director is hereby authorized and directed to execute on behalf of The City of Seattle an interlocal agreement with Seattle Public Schools, in the form negotiated and accepted by the Executive, for a program providing transit passes for Seattle Public Schools students.
Section 2. After a public hearing conducted in accordance with Revised Code of Washington 36.73.160 and pursuant to the material change policy adopted by Seattle Transportation Benefit District (STBD) Resolution 3, the scope of the project authorized by Proposition 1 is expanded to allow Proposition 1 revenues to fund:
A. Metro Transit service hours on routes with at least 65 percent of all stops within the City of Seattle, consistent with the Seattle Transit Master Plan and Metro’s Service Guidelines;
B. Metro Transit service hours on current and future RapidRide lines serving Seattle, identified in the Seattle Transit Master Plan and Metro’s long-range plan (Metro CONNECTS, Metro’s long-range plan;
C. Up to seven million dollars of the Proposition 1 Revenues may be used annually to support the implementation, management, and administration of programs to support transit use by children and youth, including the ORCA Opportunity program, which provides transit passes for Seattle Public Schools students in grades K-12, as well as students participating in the Seattle Promise scholarship or other similar programs at Seattle colleges and universities; and
D. Up to ten million dollars of the Proposition 1 Revenues may be used annually to support the implementation of City-wide improvements to maximize transit operations, including capital improvements such as enhancements to transit speed, passenger amenities, and reliability of bus service. The intent is that these capital improvements will be operationally complete by December 2020.
Section 3. In order to pay for necessary costs and expenses incurred or to be incurred in 2018, but for which insufficient appropriations were made due to causes that could not reasonably have been foreseen at the time of the making of the 2018 Budget, appropriations for the following items in the 2018 Budget are increased from the funds shown, as follows:

Section 4. Any act taken by the City or Seattle Public Schools pursuant to the authority and in compliance with the conditions of this ordinance but prior to the effective date of the ordinance is ratified and confirmed.
Section 5. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
